Framework agreement, excavation, blasting and transport services

Ski Kommune

With this Ski kommune, henceforth referred to as the contracting authority, requests tender for a framework agreement involving excavation, blasting and transport services. In connection with ongoing operations and maintenance of the contracting authority's buildings, outdoor areas, water and sewage systems, etc., there will be a requirement for excavation and landscape gardening works, with accompanying transport of machines, equipment and masses. The contracting authority has a requirement for procurement of such services, and the objective of this framework agreement is to ensure the contracting authority a swift and ongoing access to these services in accordance with requirements, and when the contracting authority lack capacity to carry out the work themselves.
The work tasks included in this framework agreement are i.a. (the list is not complete):
— Works in relation to leakages, pipe breaks, maintenance and similar, on the municipal water and sewage system.
— Works in relation to repair and maintenance of municipal roads.
— Development or repairs of outdoor areas on municipal properties.
— Excavation of building pits in connection with smaller construction works on municipal properties.
— Works in connection with installations on municipal properties, e.g. embedded oil tanks, drainage, play apparatus, etc.
— Trench blasting.
— Rock blasting.
— Blasting works will take place in a combination with transportation of masses, as well as individual blasting assignments.

Requirement
The contractors must have their affairs in order with respect to the payment of tax, payroll tax and value added tax (VAT).
The contractor must fulfil Norwegian HSE requirements for work that is carried out in Norway.
The contractor must be a legally established company.
Documentation requirement:
Tax certificates not older than 6 months from the deadline for receipt of tenders. Tax certificates means:
For Norwegian contractors:
Form from the Tax Directorate (RF-1244) for VAT issued by the tax office.
Form from the Tax Directorate (RF-1244) for tax and employer contributions/payroll tax issued by the Tax Collection Office.
For foreign contractors:
— Foreign contractors must submit equivalent certificates from their own country that show that they have their tax and duty payments in order. If the authorities in the relevant country do not issue such certificates, the contractor should submit a declaration which states that all taxes and duties have been paid. The declaration shall be approved and signed by the contractor's Financial Director/person responsible for Finance.

Norwegian contractors:
— Company Registration Certificate.
Foreign contractors:
— Confirmation that the contractor is registered in a trade register or company register in accordance with the law in the country where the contractor is established.
Økonomisk og finansiell stilling:
The contractor shall have sufficient financial strength to be able to fulfil the contract.
Minste nivå(er) av standarder:
Credit assessment from an approved credit institution, for example Creditinform, Lindorff or Dun & Bradstreet or the equivalent. This must show a minimum of ‘credit worthy’ to be approved.
The contracting authority reserves the right to demand/obtain further information in order to verify that the tenderer fulfils the requirement.
Teknisk og faglig kapasitet:
The contractor must have adequate implementation ability.
The contractor shall have good experience from similar assignments.
Contractors shall be qualified to carry out the assignment and shall work in accordance with the current laws, regulations and norms.
The contractor must have the necessary central approvals or be qualified for local approvals for the right to accept responsibility within the enterprise classifications and professions required in this competition, which are stated in point 1.2.1
The contractor shall hold environmental competence.
Minste nivå(er) av standarder:
A short, overall description of the company shall be given, including:
— An account of the company's business concept and core competencies related to the scope of the delivery.
— An overview of the company's history, organisation and ownership, as well as a description of the current business.
— Description of how the contractor is organised for the implementation of this contract.
— A concise description of the overall quality assurance system that the contractor will use for carrying out this contract.
The contractor may choose to rely on other companies' capacity to meet the technical and professional qualification requirements.
The contractor must, in such an event, document the resources of the companies on which he will rely and prove that he will have the requisite resources from these companies at his disposal during the contract period, for example by presenting a commitment statement, guarantee, co-operation agreement or similar.

This applies regardless of the legal nature of the connection between the companies, i.e. that the supporting companies can either be the contractor's parent company, another company in the same group, a co-operation partner etc.
Certificates from 3 similar contracts in the last 3 years. The certificates should be signed or confirmed in writing by the Contracting Authority for the different deliveries, and as a minimum shall include:
— A brief description of the delivery.
— Date of execution.
— Scope of delivery in monetary amount.
— Name, and telephone number of the reference person at the contracting authority.
If it is not possible to acquire signed or verified attestations, the contractor shall provide a list of all relevant assignments with descriptions according to the above points.
The Contracting Authority must have the possibility to contact the contact persons who are listed.
The contractor must hold the right to accept responsibility for the disciplines execution (UTF) and supervision of execution (KUT) in enterprise classification 2, in accordance with the Planning and Building Act.
Documented by:
— An overview of the company's professional qualifications, i.e. member of trade organisations or similar.
— It shall be substantiated that the company will achieve local approval in enterprise classification 2 (the Planning and Building Act).
Contractors shall enclose a completed self-declaration form (Annex H) that states that the company is qualified for local approval for the right to accept responsibility within the relevant disciplines, in addition documentation shall be enclosed of achieved central approval for the relevant disciplines.

Copy of environmental certification or equivalent documentation of another equivalent scheme.
If a contractor is not certified, a short account shall be provided that describes how the environment is taken care of in the company and during the production/sale of goods and/or services.
