Framework agreement regarding implementation of inhabitant hearings in connection with the municipal reform

Kommunal- og moderniseringsdepartementet (The Ministry of Local Government and Modernisation) (KMD)

KMD wishes to enter into a framework agreement with 1 provider who can implement opinion polls in connection with the hearing of inhabitants. The hearing applies to municipal mergers. Each participating municipality may place call-offs on this agreement. KMD has prepared a note with possible questions the municipalities can ask in an inhabitant inquiry, as well as instructive quality requirements in connection with the implementation. The questions must be adapted to local conditions, and the municipalities shall be given the opportunity to add further questions.
KMD enters into this agreement on behalf of Norway's municipalities, which on a voluntarily basis, can place call-offs on this agreement.

The municipalities should obtain the inhabitants' views on municipal mergers. This is also laid down in § 10 in the Division Law. This may be executed in different ways, e.g. by a referendum, popular meetings, or by implementing inhabitant hearings, e.g. in accordance with this agreement.A potential of 425 (of Norway's 428 municipalities — 3 of the municipalities have already applied for mergers) may place call-offs on the agreement in connection with obtaining the inhabitants' views on municipal mergers. C.f. the Division Law § 10. Since the municipalities can chose other ways to inquire their inhabitants, the actual number of municipalities that will enter into the agreement may be lower, and at present, difficult to quantify.All of the municipalities that participate in the reform process, and that pass a municipal council decision within 2016, will be granted 100 000 NOK to support information and inhabitants hearing. C.f. the Division Law § 10. These means will i.a. be used to cover the municipalities expenses in relation to inhabitants hearings.Primarily it is relevant for the municipalities to place call-offs on the agreement, from contract signing and until spring 2016. The request is expected to reach a peak in autumn 2015 and early 2016.

— Paid taxes and duties;
— Fulfilment of statutory requirements concerning health, safety and the environment.
Documentation requirement:
— In a transitional period of 6 months, after 14.10.2014, calculated backwards from the date of the receipt of tender, the following certificates can be attached the tender:
Tax certificate and VAT certificate no more than 6 months old issued by a competent authority confirming that the tenderer has fulfilled his obligations regarding the payment of taxes, social security contributions and VAT. The tax certificates must be issued by the tax collection office in the municipality where the tenderer has his head office and by the tax officer in the corresponding county.

From and including 14.10.2014, a new, joint tax certificate for taxes, employers' national insurance and VAT, is available. The certificate can be ordered and downloaded from Altinn, by using a separate link at the web page http://skatteetaten.no/ If this is not possible, it can be ordered from the tax collector or the Norwegian Tax Administration. The certificate is electronically certified and is therefore not signed. For further information, see http://skatteetaten.no/ The certificate shall be enclosed with the tender in accordance with the disposition given in the tender documents.

Qualification requirement:
— Adequate economic and financial capacity to carry out the delivery where, amongst other things, creditworthy with no requirements for guarantees is sufficient.
Documentation requirement:
— A credit rating with key figures from a recognised credit rating company or other form of documentation to demonstrate that the requirement has been met.

Qualification requirement:
— At least 3 relevant deliveries during the last 3 years with relevance for this contract. Relevant delivery is defined as implementation of inhabitant hearings and surveys of equivalent extent, in accordance with the description in annex 1.
— Sufficient professional expertise and capacity.
Documentation requirement:
— Reference list of all of the service provider's deliveries in the last 3 years with relevance to this assignment, stating the name of the contracting authority, value of the contract and references. What has been provided and the role the tenderer had in the assignment must be stated.
