Justification for cancellation An evaluation of the received tenders uncovered significant errors in the tender documentation. One of the tenders that was received included significant conditions and must be rejected in accordance with the public procurement regulations § 24-8 letter b). The conditions give individually and together a justifiable reason to cancel the contest. We refer to the Public Procurement Regulations § 25-4. Our notice stated that the contract period was three years, and it stated that the contract could not be extended. In the SSA-L, which the contract between the parties was based on, this is regulated as follows: Unless a different contract period or a different initiation date is agreed upon in annex 5, the contract will be valid for 3 (three) years from the date of implementation. The contract will then be renewed automatically for 1 (one) year at a time, unless 3 (three) months notice is given by the contracting authority before the renewal date. The tenderer will have an option to terminate the contract 12 (twelve) months prior to the notification of contract renewal. There are contradictions between the notice text and the tender documentation. This can have influenced both participation in and the result of the contest, and it cannot be corrected in any other way than by a cancellation, cf. for example KOFA 2020-580 with further referrals. When one of the tenders was rejected we are only left with one tender. A lack of competition then gives an independent basis for cancellation.
