The overall purpose is to procure a form system, preferably cloud-based, with one instance for the Norwegian System of Patient Injury Compensation (NPE) and one instance for the National Office for Health Service Appeals [Helseklage], delivered as a service (SaaS), and although this is not an absolute requirement, it would be in line with NPE's strategy to establish the service in the cloud. As an SaaS service, the tenderer should at minimum offer operation, maintenance, support and SLA for the service as part of the monthly fee paid by the contracting authority. The overall purpose is to procure a form system, preferably cloud-based, with one instance for the Norwegian System of Patient Injury Compensation (NPE) and one instance for Helseklage.
Tthe Norwegian System of Patient Injury Compensation (NPE) and Helseklage would therefore like to obtain quotes for a form system from stakeholders with expertise in this specialist area in the market. Through a tender process with negotiations, we would like to procure a form system that will contribute to increasing the efficiency and quality of our work. We would like the new system to make it easier for applicants to perform searches. At the same time, we want the new system to streamline everyday life for caseworkers to the greatest extent possible. This involves processing applications quickly and efficiently, receiving applications with the required information and documentation, among other things. This also means that the system must be intuitive and user-friendly, both for internal and external users. In addition, we want a system that makes it easy to maintain a complete overview of all data and easily build various reports and presentations.

The Norwegian System of Patient Injury Compensation (NPE) and Helseklage currently have around 30 forms that need to be moved (or re-created) before the system can be used. This re-establishment must be priced into the establishment project. In addition, there will be a need for additional forms and the tenderer must offer development services for the development of new forms - either through its own resources or a subcontractor. This does not involve a purchase obligation for the contracting authority, and it would be advantageous if the system can also be developed using other internal or external resources. All development that is carried out for the contracting authority must involve the contracting authority taking ownership of the forms that are developed.

The contractual relationship will be regulated by SSA-L [Agreement concerning Ongoing Purchases of Services via the Internet] with associated annexes. Requirements for the delivery are described in more detail in SSA- L- Annex 1.
The contracting authority is entering into an agreement for the delivery of the form system as a service, including the right of use, maintenance and operation.

Beskrivelse av fornyelser:
The contract will be valid from the date it is signed by the parties and has a duration of 3 (three) years calculated from the date of delivery. The contract will then be renewed automatically for 1 (one) year at a time, unless 3 (three) months notice is given by the contracting authority before the renewal date. The tenderer will have an option to terminate the contract 12 (twelve) months prior to the notification of contract renewal.

Tenderers must provide a certificate of payment of taxes, VAT and social security contributions - Documentation requirement: If the authorities in the country in which the tenderer is registered do not issue such a certificate, the tenderer is requested to provide a statement from an independent third party, such as an auditor, confirming that the tenderer has fulfilled its obligations with regard to the payment of taxes and duties. The certificate must not be older than 6 months from the deadline for application for participation, cf. section 4.3 above.

K1 - Tenderers must be a legally registered company- Documentation requirement: Company registration certificate or equivalent documentation that shows that the tenderer is registered in a business register, professional register or trade register in their home country.

Økonomisk og finansiell stilling:
K2 - Tenderers must have adequate economic and financial capacity to fulfil their obligations under the contract.
Documentation requirement: Economic and financial capacity must be documented by the following information for the legal applicant:
1. The last approved annual accounts for the two (2) last fiscal years with the annual report including the auditor's report (if obligated to perform audits) and any recent relevant information. If relevant, the most recent available preliminary accounting figures are requested to be presented.

2. Credit assessment from a company with a licence to run a credit information company. The evaluation must not be older than 3 months at the time of the application deadline, it must be based on the last approved fiscal figures and should report on the credit worthiness and degree of bankruptcy risk (bankruptcy prediction).

3. If a legal applicant relies on another company's capacity to fulfil the economic and financial standing requirement, this company must also fulfil the qualification requirement and provide the documentation stated in point 1 and 2 above, in addition too a signed commitment statement, cf. annex 2, which explicitly states that the companies joint and severally guarantee the fulfilment of the contract.

The contracting authority will assess the figures based on turnover, profitability, solidity and liquidity.
Teknisk og faglig kapasitet:
K3 - Tenderers must have good competence and capacity for the delivery and further development of the form system.
Documentation requirement: Tenderers' competence and capacity must be documented with the following information:
a. A description of the tenderer's organisation relevant for this delivery, as well as the management's relevant qualifications.
b. A description of the total competence and capacity that the tenderer has available for the establishment, delivery, operation, maintenance and further development of the form system as a service. Tenderers are asked to present an overview of the number of resources that are available, with a statement of relevant education and certificates, as well as the resources' experience with relevant systems.

c. Which resources (the number of employees as well as a statement of relevant competence/experience) belong to the tenderer and which if any belong to other companies.
K4 - Tenderers must have good experience from the delivery, operation and maintenance of a form system as a service. Relevant and comparable deliveries means assignments of a relevant nature, scope and complexity, such as deliveries to government organisations, county authorities, municipalities or large private companies.

Documentation requirement: A description of the 3 most important deliveries (preferably from public administration) in the last 3 years that are relevant and comparable to this procurement. The documentation for each delivery must state:
a. The customer's name and contact informatiom
b. A detailed description of the delivery, including the scope, value and duration. It must be clear that the delivery is a service, as well as the characteristics of the customer/delivery, such as the number of locations and number of users.
c. A brief description on why the tenderer considers the reference relevant for this contract.
d. Information on the extent to which executing key personnel for the described delivery will be available for NHN, and possibly to what degree the delivery will be carried out in cooperation with, or by, collaborating companies.
Tenderers are requested to use "Annex 7: Template for response to reference descriptions - K4"
K5 - Tenderers must have an established satisfactory management system for information security.
Documentation requirement: The requirement must be documented with at least one of the following two items:
1. Copy of a valid certificate for a management system for information security (ISO27001 or equivalent), issued by an accredited certification body.
2. Description of the tenderer’s administration and management of information security as well as how it is implemented and managed in the company. The response must be in the form of an "executive summary" (maximum 2 A4 pages).
If collaborating companies (subcontractors) are used to fulfil the requirement, their information security methods must also be described accordingly and attached to the tender offer.
The requirement must be fulfilled by both the legal applicant and any collaborating companies.
K6 - Tenderers must have established satisfactory quality management systems.
Documentation requirement: A copy of an environmental management certificate (ISO14001/EMAS/Eco-Lighthouse/equivalent), issued by an accredited certification body.
Alternatively, a description can be given of the tenderer's systems for environmental management, as well as how they are implemented and managed in the company.
K7 - Tenderers must have established satisfactory quality assurance systems.
Documentation requirement: A copy of a quality assurance certificate (ISO9001/equivalent), issued by an accredited certification body.
