The Agency for Urban Environment needs to procure a prefabricated toilet module for the construction of Økern torgpark. The park is scheduled to be completed in summer 2027. The concrete delivery date must be clarified in accordance with the Agency for Urban Environment, but it is estimated that the delivery of the toilet will take place in the second half of 2026. The toilet will be transported to the contractor who builds Økern square park, where the contractor is responsible for ground work, connection points for water, sewage and electricity to the toilet.

Kvalitetskriterium (navn): According to the Public Procurement Regulations § 7-9 (2), the Contracting Authority shall, as a general rule, weight climate and environmental considerations with a minimum of 30 percent. The contracting authority can replace climate and environmental considerations as the award criteria with climate and environmental requirements in the requirement specification, but only if it is "clear that this gives a better climate and environmental effect", cf. the procurement regulations § 7-9 (4).   With the interpretation of the wording "clearly", the Appeals Board has referred to DFØ ́s guidelines, where it is stated in point 6.1.1:  "What it is necessary for it to be clear will depend on a concrete assessment of each individual procurement. In order to identify whether it is clear that it would be better to set climate and environmental requirements in the requirement specifications, it is central that the contracting authority, during the planning of the procurement, map out     • Climate footprint and environmental impacts that the procurement has.    • Which climate and environmental considerations will have an effect on these    This gives the contracting authority the opportunity to compare the different measures and assess whether it gives better climate and environmental effect to use climate and environmental requirements, instead of taking care of the considerations in the award criteria".   A prefabricated toilet shall be procured for Økern torgpark. In order to deliver the toilet, the tenderer will depend on using the vehicle. Fossil fuel vehicles emit large amounts of Co2. The Agency for Urban Environment therefore sets a contract requirement that the vehicles that the suppliers use for transport in connection with this procurement shall be zero emission vehicles or biogas vehicles.  By setting minimum requirements for zero emission vehicles or biogas vehicles, the Agency for Urban Environment will ensure that suppliers do not emit large amounts of Co2 in their transport element. The Agency for Urban Environment is of the opinion that "clearly" it will give a better climate and environmental effect to set the minimum requirement for zero emission vehicles or biogas vehicles, rather than evaluating this. Evaluating zero emission vehicles or biogas vehicles does not mean that the best offer will be for zero emission vehicles or biogas vehicles.  Based on this, the Agency for Urban Environment will set climate and environmental requirements as the minimum requirements (contract requirements), cf. the procurement regulations § 7-9 (4).
