The framework agreement will be announced as three sub-contracts. Sub-contract I park lighting, sub-contract II square lighting, and sub-contract III Powerline-Node.. The framework agreement applies for all town areas administrated by the Agency for Urban Environment when establishing new facilities, upgrading the existing facilities and replacements due to due to errors (operation). This includes parks, green areas, and sports facilities.

The purpose of the procurement is to ensure access to fixtures to be used for outdoor lighting for the areas in which Bymiljøetaten has management responsibility. The procurement must ensure standardisation of the outdoor fixture so that the outdoor lighting gets a uniform appearance and the correct characteristics as needed to light different spaces. The standardisation will simplify the processes connected to engineering design, approval, purchasing, installation as well as management and operation of lighting system.

The contracting authority has an option to extend the contract for up to 1 + 1 year, on unchanged terms.

It is voluntary for the tenderer to offer these options. The options are non-exclusive for the contracting authority, i.e., the contracting authority is not obliged to procure these products under this contract.

Tenderers are requested to enclose a price list for replaceable modules per top mounted fixtures for gate, park and square (this includes three prices per fixture included armature driver, LED board and optics). NB these products are not included in the price evaluation.

Tenderers are requested to enclose a list of the requested products over various relevant products it is considered advantageous to have access to. NB these products will not be included in the price evaluation.

Requirement: Tenderers must be a legally established company.

Documentation requirement:

• Norwegian tenderers: Company registration certificate

• Foreign tenderers: Verification that the tenderer is registered in a trade register or company register as prescribed by the law of the country where the tenderer is established.

Økonomisk og finansiell stilling:

Credit evaluation/rating, not older than 6 months, and which is based on the last known accounting figures. The rating must be carried out by a publicly approved credit rating institution.

The contracting authority reserves the right to obtain a credit rating if needed.

Tenderers must have the economic and financial capacity to carry out the assignment.

Teknisk og faglig kapasitet:

Applies to all of the lots The documentation requirements belong under the requirements that appear under Minimum Requirement.

Documentation Requirement 1: A description of the tenderer's environmental management measures. If a tenderer has certificates from independent bodies that can substantiate an established environmental management system, certificates thereof can be presented as documentation.

The contracting authority refers in this connection to the EMAS (Eco-Management and Audit Scheme) , or other acknowledged environmental management systems stated in the decree (EF) no. 1221/2009 article 45, such as the Environmental Lighthouse Scheme, or other environmental management standards that are based on relevant European or international standards from accredited bodies, e.g., ISO 14001 or equivalent.

Documentation requirement 2: A description of the system for managing the supplier chain that the tenderer will use to carry out the contract. This includes quality assurance measures that enable systematic follow-up of the work on safeguarding basic human rights, the ILO's core conventions and the international law's regulations related to the delivery in this agreement, including relevant UN decisions that Norway is obliged to downstream in the supply chain / production process.

A description of the tracking systems that the tenderer will use to fulfil the contract. The description must state methods and/or systems that enable tracking of the production locations and country of origin involved in the supplier chain for the goods in this contract.

Documentation requirement 3: The tenderer must deliver an overview of the primary equivalent goods deliveries the tenderer has carried out during the last five years, together with information about the work nature, scope and value as well as time and location for execution of the work.

Minste nivå(er) av standarder:

Minimum requirements that apply to all of the sub-contracts.

Requirement 1. Environmental management measures must have been established, ensure that the tenderer is suitable to comply with the contractual obligations for environmental regulations. This means that the tenderer must have methods for working actively and systematically on reducing negative environmental impact from the tenderer activities related to the implementation of this contract.

Requirement 2: Tenderers are required to have implemented quality assurance measures ensuring that the tenderer is suited to fulfil the contractual obligations for social requirements . This means that the tenderer has methods for managing the supplier chain and tracking systems that enable follow-up of compliance with

• Basic human rights, including, amongst other things:

o No person must be subjected to torture or gruesome, inhuman or degrading treatment or punishment (UN’s Universal Declaration of Human Rights art. 5)

o All workers have the right to fa and good payment that ensures them and their family a dignified existence, and if necessary, complemented by other social protection (UN’s Universal Declaration of Human Rights art. 23.3).

o Everyone has the right to rest and leisure time, including reasonable limiting of work hours and regular holidays with pay. (UN’s Universal Declaration of Human Rights art. 24)

• ILO's core conventions:

o ILO convention no. 138 and 182 (ban on child labour), nos. 29 and 105 (ban on discrimination) and numbers 100 and 111 (ban on discrimination) and nos. 87 and 98 (freedom of association and right to collective bargaining).

• International law's regulations that related to the delivery in this agreement, including relevant UN decisions that Norway have signed.

Requirement 3 is specified for each sub-contract:

Requirement 3 Sub-contract I: Tenderers must have experience from at least three equivalent deliveries in the last five years. Equivalent deliveries mean deliveries of park fixtures in Nordic climates with more than 10 fixtures per order.

Requirement 3 sub-contract II: Tenderers must have experience from at least five equivalent deliveries in the last five years. Equivalent deliveries means delivery of square fixtures in a Nordic climate with deliveries of more than 8 searchlights per order.

Requirement 3 sub-contract III: Tenderers must have experience from at least one equivalent delivery in the last five years. Equivalent delivery means delivery of Powerline-node for outdoor lighting in a Nordic climate with delivery of more than 30 nodes per order.

Vilkår for kontraktoppfyllelse:

The contractual relationship will be governed in accordance with the attached contract and associated standard contractual terms for Oslo Municipality’s purchase of goods.

The contracting authority wants to make the tenderer particularly aware of point 14 Social contract terms. The requirements are in points 14.1 and 14. 2 in the contract formula and applies to all of the sub-contracts.

We also refer to the attachment ‘Tips for suppliers - Adherence of social requirement 05.11.2021’
