Justification for cancellation Cancellation of the contest: Alternative learning arenas for Asker Municipality - contract no.: 22/11 Background Asker Municipality (hereafter called the contracting authority) announced 'alternative learning arenas' for Asker Municipality - contract no. 22/11 on 4.4.2022 with the tender deadline on 9.5.2022 at 12:00. The contracting authority received five tenders. Assessment The contracting authority believes that the award criteria 'hourly rates - NOK excluding VAT' has been answered by several tenderers in a way that means that the tenders cannot be compared. The PPR § 25-4 'cancellation of a contest' states: 'The contracting authority can cancel the contest with immediate effect if there is justifiable cause'. The contracting authority sees the fact that it has not clarified the award criteria 'hourly rates - NOK excluding VAT' adequately as a justifiable reason to cancel the contest. Conclusion Based on the received tenders, the contracting authority sees that the award criteria 'hourly rates - NOK excluding VAT' has not been specified adequately by the contracting authority. The contracting authority cannot compare the received tenders on the award criteria 'price'. The requirement that the contracting authority must notify and justify its decisions must be seen in the light of the basic principle in the Public Procurement Act § 4 of ensuring verification in the procurement process. The contracting authority is using the 'Public procurement Regulations § 25-4. Cancellation of the tender contest. (1) The Contracting Authority can cancel a contest with immediate effect if there is a justifiable reason.' We apologise for this.
