Froland kommune

Froland Municipality has decided to construct a new nursing home with 60 places located in Nesbakken.
This procurement concerns contracting a contractor for the interaction phase, with transition to a turnkey contract for the new nursing home.
The project will be executed as an interaction contract, divided into two phases — a project development phase (phases 0 and 1) and an interaction phase (implementation, phase 2).
The contracting authority would like interaction in the early phase with users/the engineering design group and the contractor to develop the project with good and cost-efficient solutions. After this the plan is to sign a turnkey contract with a fixed price for the implementation phase. An incentive agreement will not be used.
The contracting authority has engaged the engineering design group, including the architect, which the interaction contractor must use and cooperate with in phases 0 and 1.

Froland Municipality signed a contract with Kruse Smith Entreprenør AS for a partnering contract for a new nursing home at Nesbakken in Froland, September 2021. A progress plan was established in accordance with the contract, with partnering and engineering design services up until mid April 2022, with a start-up of the execution in mid April 2022, and hand-over by the end of February 2023. Obstacles for the project arose during the partnering phase. Firstly, it was clarified in the budget process for 2022 that resources have not been set aside for a start-up of the execution in 2022. Secondly, seepage has been found at the construction site, which has triggered a need for comprehensive ground surveys before the work can commence. Based on the above, amongst other things, the execution phase has been postponed from 2022 until 2023. The change is considered to fall under the public procurement regulations, section 28-1, and does not involve (1) a change to the general character of the procurement, or (2) a price increase of more than 50% of the original contract value.

Sanctions in accordance with the Public Procurement Act dated 17 June 2016 (PPA), section 13 first paragraph, letter a, or section 14, first paragraph, letter b, can only be sentenced when a lawsuit is raised within 30 days calculated from the day after the date of the notice of this voluntary ex-ante transparency notice. If the dispute solving organ receives a complaint with a declaration of an illegal direct procurement, the deadline is suspended, cf. the PPA, section 15, fifth paragraph.
