Evaluation of the Regulation on tripartite shift work and rota

Working hours for shift work and rota, and equality of working hours for employees in the rota system with employees in so-called fully continuous shift work, have been discussed numerous times. The issue was part of the Shift / rota committee's work (NOU 2008: 17), after which the committee proposed a new regulation for tripartite shift work and rota. The proposal was followed up in Ot.prp. no. 54 (2008-2009) Regarding the Act on Amendments to the Working Environment Act (equality of working hours for shift worker and workers in Rota systems, etc.). The proposal, a system with gradual compensation for inconvenient working hours, was included in the Working Environment Act §10-4 (6) with effect from 1 January 2010. The system shall now be subject to evaluation.

Qualification requirements
The tenderer must be a legally established company.
Documentation Requirement
• Norwegian companies: Company registration certificate or a printout from the Unit Register for single person companies not required to register.
• Foreign companies: Confirmation that the company is registered in a trade or business register as prescribed by the law of the country where the tenderer is established. Confirmation can be delivered in writing or by reference to BRIS.

Documentation Requirement
• A certificate, not older than six months, which verifies that the tenderer has fulfilled the obligations of payment of taxes, social security contributions and VAT. The certificate can be ordered and obtained from Altinn by using a separate link on skatteetaten.no. If this is not possible, it can be ordered from the tax collector or the Norwegian Tax Administration. The certificate is electronically certified and is therefore not signed. For further information, see skatteetaten.no.

• Foreign tenderers must submit certificates from authorities equivalent to the Norwegian authorities.
Tenderers must have sufficient economic and financial capacity to carry out the delivery, in which, amongst other things, being creditworthy without any requirement for collateral will be adequate.
• A credit rating with key figures from a recognised credit evaluation agency or other form of documentation to demonstrate that the requirement has been met.

Tenderers must have sufficient ability and experience to carry out the delivery.
Documentation Requirement
Tenderers or the offered personnel must be able to refer to minimum three assignments for the last three years with relevance to this assignment, stating the name of the contracting authority, and, if possible, the value of the assignment and reference. Relevant assignments are in this context defined as assignments that show review and/or research competence and solid experience with surveys and analyses related to the working life field. What has been delivered and the function the tenderer had in the assignment, must be stated.
