Oslo kommune v/Fornebubanen

The Fornebu Railway will be a new underground stretch in a connected tunnel system from Majorstuen in Oslo to Fornebu in Bærum. The railway will be approx. 8 km long with 6 stations: Fornebu, Flytårnet, Fornebuporten, Lysaker, Vækerø and Skøyen.
Most of the work under this contract will be:
— demolishing the existing buildings at Fornebu south, a total of approx. 75 000 m buildings,
— clearing the building matter, loading, transport and disposal at a certified site,
— excavating and blasting a construction pit, approx. 600 000 fm of an expected approx. 40 % uncompacted matter and 60 % rock,
— sheet piling and securing, injection for a sealed construction pit,
— loading, transport and disposal of lightly polluted (classes 2 and 3) uncompacted matter at a certified site,
— loading, transport and disposal of blasted stone at a certified site.

Requirements for the tenderer (legal company)

Tenderers must be a legally established company

Documentation, legal company:

— Norwegian companies: company registration certificate,

— foreign companies: proof that the company is registered in a trade or a register of business enterprises as prescribed by the law of the country where the tenderer is established,

— tenderers must also document the conditions requested in points 4.1.1 and 4.1.2 below.

4.1.1) information on the tenderer:

— tenderer's name,

— post and visitors address,

— contact person, telephone number and email address,

— organisation plan at company level,

— description of the owners and ownership structure.

If a tenderer is in a working partnership, or will rely on other companies in order to be qualified, the relationship between the involved parties must be documented. All those involved must submit the requested information.

4.1.2) Support from other companies, cf. the utilities regulations §12-5

If a tenderer is in a working partnership, a copy of the working partnership agreement, or what has been signed between the members, must be submitted. The working partnership must bind the parties to joint and several liability for the execution of the work in accordance with the contract.

If the working partnership agreement has not been signed, the attached commitment statement must be completed and signed as documentation that such an agreement will be signed. This commitment statement must be attached for the companies that the tenderer will rely on in order to fulfil the ‘economic and financial capacity’ or ‘technical and professional qualifications’.

If a tenderer will rely on other companies in order to fulfil the ‘technical and professional qualifications’, documentation must be submitted on what work these companies will actually carry out.

ESPD requirements:

Tenderers must submit the ESPD together with the qualification documentation.

In cases where a tenderer will rely on other companies' capacity in order to fulfil 1 or several of the qualification requirements, these companies must also complete an ESPD form.

Completed ESPD self-declaration form.

The ESPD form must be submitted in PDF and/or XML file format.

Requirements for economic and financial capacity.

Tenderers must have good and sufficient economic and financial capacity to ensure implementation ability for the entire contract period. A general assessment will be made of the tenderer's economic and financial capacity, including development over time, with a focus on key figures such as liquidity, equity, debt ration, etc.

The following minimum requirements must be met:

— average annual turnover greater than 500 000 000 NOK for the last 3 fiscal years.

Documentation:

The annual accounts including notes, with the accompanying auditor's report for the last 3 fiscal years (normally 2016-2018) for all of the legal unit that applies.

Foreign tenderers must submit their annual accounts, including notes, in Norwegian (Nordic) or translated to English for the period mentioned above.

Submit a table that shows the values and key figures for the last approved periods, (normally 2016-2018), with supporting documentation for the calculations.

NB: if there is doubt, the contracting authority's assessment of the key figures will be assessed against the average for the branch.

For collaborating companies (working partnership):

If a tenderer is a collaborating company, complete documentation must be obtained for each individual company included in the collaboration.

The assessment will be made for the participants as a whole for collaborating companies.

Teknisk og faglig kapasitet:

Requirement, experience and knowledge:

— tenderers must have sufficient experience and knowledge from assignments of an equivalent or relevant nature,

— tenderers must refer to relevant experience from the following types of work:

—— ground work;

—— open-air blasting;

—— sheet piling;

—— strict water cleaning requirements;

—— demolition and removal;

—— handling matter;

—— disposal of environmental waste;

—— experience from work in densely populated areas.

The list is not exhaustive and the contracting authority can emphasise other relevant conditions connected to the tender documentation.

Documentation, experience and knowledge:

A description of minimum 5 references, not older than 10 years.

The description ought to include:

—— project name/location;

—— contract name or term.

— customer:

—— the customer's project manager with contact information;

—— description of the contract;

—— description of the contract's relevance for this pre-qualification;

—— description of the tenderer's role and responsibility;

—— contract value;

—— internal control/HSE/safety;

—— technical methods used;

—— experience with model based documentation (BIM);

—— professions and activities included in the reference projects;

—— start date and completion date;

—— partners and sub-suppliers;

—— environmental follow-up for handling hazardous waste.

If a tenderer will rely on other companies to fulfil the qualification requirement, it must be clear how the group of companies together fulfil the qualification requirement.

The contracting authority can contact the stated contacts for the reference projects and emphasise the feedback given.

The contracting authority will, as a starting pint, base the evaluation on the given references, but reserves the right to include its own experience, both positive and negative, that the contracting authority has with the tenderer.

Documentation under this point will be used by the contracting authority to find the best qualified, cf. point 4.5 ‘Selection Criteria’.

Requirement, quality system:

Tenderers must have a documented and well-functioning quality system that fulfils the requirements in ISO 9001:2015 or later editions.

Documentation, quality system:

A copy of a NS-EN ISO 9001:2015 certificate or equivalent, issued by an accredited quality assurance institution.

An overview of inspection plans and check lists that are relevant for this type of work.

Alternatively:

An account including a general description of the content of the quality system. The account must include a compatibility matrix as regards NS-EN ISO 9001:2015.

Requirement, environmental management system:

Tenderers must have a documented and implemented environmental management system that fulfils the requirements in NS-EN ISO 14001 or EMAS, or equivalent.

Documentation, environmental management system:

— a copy of a valid certificate from third party verified systems such as NS-EN ISO 14001, EMAS or equivalent,

— An overview of inspection plans and check lists that are relevant for the contract, or

— An account (maximum 5 A4 pages) that documents compliance with equivalent requirements, with a general description of the content of the system, including an overview of environmental plans and check lists that are relevant for the contract.
