Bane NOR will construct a new double track between Sandbukta in Moss and Såstad in Rygge. An application has been sent to the County Governor in Østfold (now Oslo and Viken) for an emissions licence in accordance with the Pollution Act § 11 for the planned work in Moss and Rygge Municipalities in the turnkey contract (SMS 2A). The assignment involves, amongst other things, making a measuring programme and monitoring programme for emissions in accordance with the emissions licence.

Reason for the cancellation: Two (2) tenders were received in this competition. Both tenderers were rejected from further participation in the competition as they did not fulfil the qualification requirements, see the Utilities Regulations § 20-2 (1) letter a. After this the Contracting Authority did not have further tenders to continue with the competition. This resulted in the Contracting Authority having a justifiable reason to cancel the competition, see the Utilities Regulations § 21-4 (1). A new competition will be held for the area. The tender documentation will not be changed. Due to the cancelled competition, the Contracting Authority fulfils the requirements in the Utilities Regulations §9-2 (a) to hold a negotiated procedure without a prior notice.
