Frogn Kommune

Open tender competition for engineering design services for and the construction of, (turnkey contract), a total of 25 sheltered accommodation flats in two separate projects, called Belsjø terrasse and Ullerud terrasse. The contracts also include outside areas within the development plans for the sites, as well as seeing to sequencing requirements at Ullerud terrasse, in accordance with the provisions in the development plan. A joint contract will be awarded for the 2 projects, i.e., 1 competition winner will be appointed. Tenders must, thus, be submitted for both projects. The site areas where the sheltered accommodation flats are to be established make up parts of 2 larger development areas owned by Frogn Municipality. The remaining part of the sites will belong to the tenderer and can be used commercially. The value of these site areas (the purchase sum) must be included as part of the tender price submitted by the tenderer.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
1) Tenderers must be a legally registered company.
Documentation: norwegian companies: company registration certificate.
Foreign companies: registration certificate in a professional register as determined by legislation in the country where the tenderer is established. The documentation must, at a minimum, state:
(a) the company´s name and registration number,
(b) the company´s business address,
(c) who can act on the company's behalf/bind the company.
2) Tenderers must fulfil their tax, VAT and payroll tax obligations. Arrears can lead to rejection.
Documentation: norwegian companies: tax, VAT and payroll tax certificate.
Foreign companies: foreign tenderers must provide certificates from equivalent authorities to the Norwegian authorities.
The tax certificate must not be older than 6 months from the tender deadline.

Tenderers must:
(i) have the financial solidity to fulfil the contract; and
(ii) provide the necessary security in accordance with NS 8407 Point 7.2.
Documentation:
The company's Annual Financial Statements including notes with the boards and auditor’s report for 2017. In addition the Contracting Authority will obtain a credit assessment/rating themselves. The minimum rating must be equivalent to double A or better.

If a tenderer has valid reasons for not being able to provide the documentation requested by the Contracting Authority, the tenderer can prove his economic and financial position by presenting, for example, a declaration from a financial institution on surety. A declaration of surety, etc., can also be presented to redress a shortcoming as regards the minimum rating requirement.

An advanced commitment from a credit institution for security of equal value to 10 % of the tender sum (contract cost) including VAT.

Teknisk og faglig kapasitet:
1) Tenderers must have systems for quality assurance.
Documentation: documentation must be given in one of the following ways:
(i) certificate for the company's quality system/management system issued by independent bodies that confirms that the tenderer fulfils certain quality assurance standards, for example ISO 9001:2015. Quality management standards must be based on relevant European standards that are certified by accredited bodies;

(ii) the Contracting Authority will accept other documentation of equivalent quality assurance measures if a tenderer does not have the possibility to obtain such certificates by the deadline, and this is not the tenderer’s fault. This requires that the tenderer documents that these measures are equivalent to the requested quality assurance standards. As a minimum, a general description of the system's content, including an overview of inspection plans and check-lists that are relevant for this contract, must be submitted.

2) Tenderers must have experience from assignments that are relevant for the assignment's nature, size/scope and complexity. An overview of the most important building and construction work that the tenderer has carried out in the last 3 years (maximum three). The name of the Contracting Authority must be given.

Property developers who do not have experience themselves from building and construction work can rely on others for experience/competence and capacity (see the tender documentation).
