Dealer contract for SAN and storage technology from IBM

Brønnøysundregistrene [The Brønnøysund Register Centre]

The Brønnøysund Register Centre shall enter into a three year contract for the procurement of dealer services for SAN and storage technology from IBM. The contract shall cover the purchase of machinery with associated software, associated support and maintenance services and other services the dealer can offer. The contract, with existing terms, shall have an unilateral option for the Brønnøysund Register Centre to extend the contract for a further 1+1+1 year. The options for extensions will automatically be taken up if the Brønnøysund Register Centre does not give notice on the contract at the latest 1 month before it expires.

Egnethet til å utøve yrkesvirksomheten:
Tax and VAT certificate (not older than 6 months from the tender deadline).
Company Registration Certificate:
The Brønnøysund Register Centre shall obtain the company certificate from the Company Register. Foreign tenderers must attach certificate that prove they are a legally established company and that they are registered in the professional registered as determined by the law of the country in which the tenderer is established.

The requirement for tax and VAT certificate means that tenderers with company addresses outside of Norway must submit certificates that confirm the tenderer has their tax and duty payments in order in their homeland. The certificate shall be issued by a public authority with permission to issue such certificates. If a tenderer's home country does not issue such documents or certificates, they can be replaced by a declaration given under oath or affirmation by the relevant person to a legal or administrative in the home country or current country of residence, a notarius publicus or other competent authority in the home country or current country of residence.

Økonomisk og finansiell stilling:
The company's most recent Annual Accounts with notes, including any new information of relevance to the company's accounting figures.
If the tenderer has valid reasons as to why such documentation cannot be obtained, or that the economic situation has changed significantly since the last submitted annual financial statement, the tenderer can prove his economic and financial position with other documentation acceptable to the contracting authority. If a tenderer has such valid reasons, he may contact the contracting authority in writing in order to clarify which other documentation is acceptable. The Brønnøysund Register Centre reserves the right to obtain a credit rating of the tenderers.

The tenderer is required to have satisfactory economic and financial ability to carry out the agreement. The tenderer's solidity, liquidity and financial strength set up against the procurement's total value and contract length will be central in this assessment.

Teknisk og faglig kapasitet:
An overview of the service provider's most important contracts in the last three years. This must specify the content of the contract, value, length and the name of the contracting authority.
The Contracting Authority will accept relevant contracts from the Nordic countries, including Norway, Sweden, Denmark, Finland and Iceland.
The template, annex 2 must be used.
