Security shall be provided for 10 % of the contract amount in the execution period.

1. HSE card
All employees shall carry an easily visible and valid HSE card issued by the Norwegian Labour Inspection Authority. Order confirmation, application form etc. will not be accepted as an HSE card. Employees who do not have an HSE card will be turned away from the construction site.

All contracts entered into by the tenderers involving the execution of work in accordance with this contract shall contain similar provisions.
The card shall be used for registering attendance at the construction site.
2. Requirement for skilled tradesmen
Under execution of the contract work, a minimum of 40 % of the worked hours in the building and construction disciplines (the disciplines that are included in the education programme for building and construction technique as well as the site gardener subject) combined shall be carried out by people with a certificate of apprenticeship, craft certificate or documented vocational training in accordance with the national Vocational Training Act or equivalent foreign specialist education. There shall be skilled workers in all of the above named disciplines.

The requirement can be fulfilled by the worked hours being carried out by persons who are under systematic training and registered in accordance with the requirements in the Practice Candidate Scheme, cf. the Education Act § 3-5, or in accordance with an equivalent scheme in another EU/EEA country. The above requirement applies to the owner of sole-trader companies without employees.

The tenderer shall, after the contract has been signed, give an account of how the requirement will be fulfilled, as well as regular notifications of manpower plans and reports showing the degree of fulfilment.
The builder can stop the work if there is reason to believe that a breach will occur and the condition is not corrected within a reasonable deadline, given in a written warning from the builder.
3. Apprentices
Under execution of the contract work, a minimum of 7 % of the worked hours in the building and construction disciplines combined (the disciplines included in the education programme for building and construction technique, and the site gardener discipline) shall be carried out by apprentices, cf. the Education Act § 4-1.

The requirement can be fulfilled by the worked hours being carried out by persons who are under systematic training and registered in accordance with the requirements in the Practice Candidate Scheme, cf. the Education Act § 3-5. The requirements can also be fulfilled by using apprentices in accordance with an equivalent scheme in another EEA/EU country and persons who are under systematic training and registered in accordance with an equivalent scheme to the requirements in the Practice Candidate Scheme, cf. the Education Act § 3-5, in another EU/EEA country.

The requirement can be fulfilled by the tenderer and one or several of his sub-suppliers.
If the work is not suitable due to the nature of the work and for health, environment and safety reasons, the builder can allow deviations from the percentage requirements.
Tenderers shall at the start, and upon request, during the execution of the contract work, substantiate that the requirements are fulfilled. An overview of the number of apprentice hours shall be presented at the end of the contract. Time sheets shall be presented upon request.

4. Reporting obligation to the Central Tax Office for taxation office for foreign affairs.
Contracts given to foreign tenderers or sub-suppliers, and all employees in such a contract, shall be reported to the Central Tax Office for foreign cases in accordance with the Tax Assessment Act § 5-6.
Tenderers are responsible for ensuring that such reporting occurs in the entire contract chain. Tenderers shall, upon request, document that the reporting obligation is fulfilled by a copy of the reporting form or a receipt from Altinn.
Any liability for taxes and duties, fees or imposed fines from the builder resulting from the tenderer not complying with his obligations in accordance with this point, falls to the tenderer and shall be paid by him.
5. Internal control. Health, working environment and safety (HSE)
Tenderers, shall always comply with the current working environment law with the accompanying regulations, the builder's HSE plan and the builder's or coordinator's indicators. Tenderers are obliged to have an internal control system in accordance with the regulations on systematic health, environment and safety work in entities. Relevant parts of the builder's HSE plan shall be incorporated and followed-up through the tenderer's internal control. The incorporation shall occur so that the HSE plan's regulations can be identified.

Unless otherwise agreed, all communication between key personnel in the project shall be in Norwegian. Tenderers shall ensure that his employees and any sub-suppliers used can communicate in such a way that a lack of communication does not represent a safety risk. In order to avoid accidents occurring from not everyone understanding given information, the following applies:

— At least one of the executing personnel in each work team shall be able to understand and be understood in Norwegian. If several persons are carrying out an assignment together, the persons in question shall, in addition, understand and be understood in a language that the others in the work team understand and can be understood in.

— All persons at the construction site shall understand the HSE plan, safety training, HSE routines, protection protocols, safety instructions, SJA, safety data-sheets, instructions for tools and work equipment, warning signs etc. The material shall be available in the language that the workers in question use as their first language, if the worker does not completely understand the information in Norwegian.

If there is a breach of the above mentioned obligations, the builder has the right to stop the work to the degree that the builder deems necessary.
Significant breaches of the above mentioned obligations, which are not corrected within a reasonable deadline, can be pleaded by the builder as a basis for cancellation. If there are repeated breaches of the obligations, the builder can cancel the contract himself, even if the tenderer corrects the conditions. The builder can, in the same way, demand that the tenderer replaces sub-suppliers. This shall be carried out at no cost to the builder.

6. Requirements for wages and working conditions
The tenderer is responsible for ensuring that their own employees, sub-contractors employees (including hired) have wages and working conditions in accordance with:
— Regulations on general tariff agreement.
— Regulations on wages and working conditions in public contracts dated 8 February 2008, where applicable. For areas not covered by the Regulations on Common Tariff Agreements, the wages and working conditions shall be in accordance with the prevailing nationwide tariff agreement for the relevant branch. Wage and work terms mean provisions on minimum working hours, wages, including overtime supplements, shift and rota supplements and inconvenience supplements and coverage of expenses for journeys, food and lodgings, to the degree that such provisions are in the tariff agreement.

The tenderer is obliged, upon request, to document wages and working conditions for his employees, employees at any sub-suppliers (including hired). The information shall be documented by, amongst other things, a copy of a work contract, wage slip, time sheets and the employer's bank statement. The documentation shall be on a personal level and it shall state who it concerns.

The tenderer shall correct any breach of the wages and working conditions requirements. If the breach has occurred at a sub-supplier (including manpower companies), the correction obligation is limited to demands that are advanced in writing within three months of the wage due date, both for demands resulting from a general tariff agreement and nationwide tariff agreements. The terms and limitations resulting from the law on general tariff agreements etc. dated 4 June 1993 § 13 shall apply in both of these cases.

The builder has the right to retain an amount equivalent to approx. twice the savings for the employer. The retention right ceases as soon as the a correction in accordance with previous paragraph is documented. Significant breaches of wages and working conditions at the tenderer can be pleaded by the builder as a basis for cancellation of the contract, even if the tenderer corrects the conditions. If the breached occurred in the sub-supplier chain (including manpower companies), the builder can, in the same way, require that the tenderer replaces the sub-supplier. This shall be carried out at no cost to the builder.

7. Relative to the Planning and Building Act.
It is a contract requirement that the tenderer has the necessary qualifications to meet the requirements in Pbl. and other relevant laws and regulations, including the regulations on approval of companies for the right to accept responsibility. Lack of approvals will be considered as a significant breech of contract which gives the Contractor the right to cancel the contract, as well as require reimbursement for all losses resulting from the situation. Before cancellation can take place, the Contractor must have given the tenderer a reasonable deadline to correct the situation.

8. Specific requirements for competence.
The Contract intends to manage progress planning and execution of the construction works by using the LEAN methodology. The methodology aims to imrpove the productivity on the work site and reduce construction errors.
The tenderer is obliged to be present for planning meetings, with the necessary expertise required in LEAN. The Contractor undertakes to arrange courses, so that the planning occurs with the same degree of competence. Course fees must be covered by the tenderer for equal distribution on the number of participants.
