K 01 Tax and VAT certificate — Requirement: Tenderers are not to have significant tax or VAT arrears, or an approved repayment plan exists. Norwegian tenderers shall present a joint tax and VAT certificate. This certificate can be ordered by the tenderer through Altinn: www.altinn.no/no/Skjema-og-tjenester/Etater/Skatteetaten/Attestbestilling/ This certificate must be presented before the tender deadline and must not be older than six months from the tender deadline. Foreign tenderers must provide certificates from equivalent authorities to the Norwegian authorities.

K 02 — Company registration certificate — Requirement: Tenderer shall be a legally established company. The contracting authority requires tenderers who wish to participate in the competition to demonstrate that they are registered in a trade index or other enterprise register as prescribed in the legislation in the country in which they are established. Documentation of this (e.g. a Business Registration Certificate from the Brønnøysund Register Centre) shall be enclosed with the tender.

Økonomisk og finansiell stilling:

K 05 — Credit rating — Requirement: The tenderer shall have the financial ability to fulfil the contract. As documentation the contracting authority will obtain the credit evaluation Commercial Delphi Score from Experian (The contracting authority subscribes to services from Experian). The tenderer must as a minimum achieve a rating of ‘Credit worthy’, i.e. the tenderer must be in risk classification 5 or higher on the Experian scale. The tenderer is expected to have familiarised himself with registered information about the company and by submission of the tender accepts that the information will be obtained and form the basis of the assessment of the tenderer's financial situation. If the tenderer knows that the requirement regarding the financial capacity to carry out the contract cannot be met via the credit rating as specified above, the tenderer can submit other documentation with the tender that confirms/explains a satisfactory financial capacity. If the contracting authority's credit information about the individual company does not include a credit rating, the contracting authority will seek to have this documentation requirement met in another way, either by assessing whether the financial capacity is satisfactory based on the other information that should be available in the solution from Experian or by obtaining other documentation.

Teknisk og faglig kapasitet:

K 04 — Special competence certificates — Requirement: The person who shall use fireworks classification IV as well as firework rockets classification II and III (display fireworks) pyrotechnic stage effects, shall have a special certificate of competence, c.f. § 13-1 in the Regulation for handling explosives (FOR-2002-06-26-922). Documentation: A copy of the special competence certificate shall be presented, in accordance with the above mentioned requirement. Certificates of competence for use of display fireworks are issued to those who have implemented courses and passed the exam by a course administrator appointed by the Norwegian Directorate for Civil Protection (DSB), and can present documentation showing minimum 10 firework launchings/arrangements with fireworks classification IV. DSB has appointed the Norwegian Fire Protection Association to arrange courses and administer exams. the Norwegian Fire Protection Association Information on the courses and course dates are found on the Web site for the Norwegian Fire Protection Association (www.brannvernforeningen.no ).

K05 — Experience and the ability to implement the contract Requirement: Experience from relevant assignments involving the delivery of fireworks of corresponding scope and complexity, as described in the tender documentation. Several smaller, relevant contracts within the same time frame can overall give the supplier an equivalent qualification. Documentation of excellent implementation ability is required. In order to document this, a list shall be enclosed of the most important deliveries or services performed in the last three years, and this shall include information on:

— Short description of the assignment,

— Size or value of the assignments,

— Date (contract period),

— Name of the customers and a short description of thereof,

— Telephone number, e-mail address and name of contact persons at the customers. Relevant customers from the list can be contacted.

K06- The tenderer shall have a quality assurance system, which shall ensure that the tenderer is able to fulfil the ethical contractual conditions that apply for this framework agreement. This means that tenderers must have methods of quality assurance which describe how the company works to comply with ethical trade in operations and in the supply chain. In order to comply with this requirement, the tenderer must fulfil sub-requirements in relation to the following conditions:

1. System for traceability in the supplier network.

2. Risk analysis for selected products.

3. Communication and system for following up Code of Conduct in the supplier network.

A description of each sub-requirements and documentation requirements is stated in a separate annex. ‘Sub-requirements and reply form for ethical trade’. NOTE: Tenderers shall document and fill in the form in accordance with the specifications in the annex. A guideline on how one can work systematically with ethical trade is available on the Initiative for ethical trade (IEH) website at www.etiskhandel.no/veileder/

K07 — Environmental management system: The tenderer shall have an environmental management system which guarantees that the tenderer is able to comply with environmental requirements given in the tender documents and the contractual obligations. The tenderer shall enclose a brief statement, maximum one (1) A4 page. The statement shall describe the tenderers declared environmental goals, status on the environmental works in own company and planned measures with relevance to this contract. As an alternative, the tenderer can enclose documentation of relevant environmental certification. E.g. ISO 14001 or EMAS — Eco-Management and Audit Scheme [1], the Eco-Lighthouse system or other documentation.
