Hordaland Fylkeskommune v/Bybanen Utbygging

Bybanen Utbygging shall enter into a framework agreement with one — 1 — contractor who shall carry out minor work connected to traffic safety measures, improving existing solutions, supporting work for technical contractors and other work of a similar nature on the stretch between the centre of Bergen and Lagunen (Construction stages 1 and 2). In addition there will be an option to extend the framework agreement for 1 + 1 year for further and equivalent work on the entire stretch from the centre of Bergen to Flesland (including construction stage 3 Lagunen — Flesland). The stretch Lagunen — Flesland is expected to open summer/autumn 2016.
Examples of work that shall be carried out are the construction of minor concrete or natural stone walls, the assembly of fences and guide rails, minor asphalt work, landscape work, as well as minor water and sewage and drainage work. The complete extent of the work to be carried out cannot be clarified, only individual measures have been decided.
Continual call-offs will be required for each individual measure as and when these have been engineered and decided. Parts of the work will have to be carried out in the evenings or at night due to the light rail's regularity and possible disturbances.
The contract is estimated to have an annual value of NOK 2 000 000 excluding VAT. Emphasis is put on the fact that this estimate is not binding in any way and the call-offs that are made will be based on the actual need.

The framework agreement is for 2 years with an option for a contract extension of 1+1 year. The contracting authority will have a unilateral right to take up the option for an extension.

Requirement #1: Application letter

Documentation requirement #1: Contractors must present a signed application letter. Preferably use the template in annex 1.

Requirement #2: The contractor must have their tax, payroll tax and value added tax (VAT) payments in order.

Documentation requirement #2: Tax certificates not older than six months when calculated from the qualification deadline.

Tax certificates are defined as:

For Norwegian contractors:

— Certificate for tax and VAT RF-1244 issued by the Tax Office (joint certificate — new scheme that came into being 1.10.2014).

For foreign contractors:

— Foreign contractors must submit equivalent certificates from their own country that show that they have their tax and duty payments in order. If the authorities in the relevant country do not issue such certificates, the contractor should submit a declaration which states that all taxes and duties have been paid. The declaration shall be approved and signed by the contractor's Financial Director/ person responsible for Finance.

Requirement #3: Tenderers must fulfil Norwegian HSE requirements for work that shall be carried out in Norway.

Documentation requirement #3: Filled in and signed HSE self-declaration in accordance with PPR appendix 2. Preferably use the attached template, see annex 2.

Requirement #4: The contractor shall be a legally established company.

Documentation requirement #4:

Norwegian tenderers:

— Company Registration Certificate.

Foreign tenderers:

— Confirmation that the tenderer is registered in a trade register or company register in accordance with the law in the country where the tenderer is established.

Requirement #5: Tenderers shall follow the eight fundamental ILO conventions and there shall be continual systematic work to ensure that the company's sub suppliers comply with the requirements.

Documentation requirement #5: A signed self-declaration — The eight fundamental ILO conventions (the template in annex 4 can be used).

Økonomisk og finansiell stilling:

Requirement #6: The contractor shall have sufficient financial strength to be able to fulfil the contract.

Documentation requirement #6: The contractor's annual accounts including notes with the board's and auditor's reports for 2013 and 2014.

If the annual accounts from 2014 are not yet completed by the tender deadline for this competition, the annual accounts for 2012 and 2011 shall be enclosed in addition to the annual accounts for 2013.

The contracting authority reserves the right to carry out a credit assessment from the credit rating company Experian. Financial strength is evaluated in relation to turnover, operating profit margin, solidity and liquidity.

The above mentioned information shall also be provided for any parent company, where necessary. See point 3.7 for details.

Teknisk og faglig kapasitet:

Requirement #7: The contractor shall have good conduct.

Documentation requirement #7: Contractors shall confirm in a self-declaration that the requirements in Annex 3 are fulfilled, cf. FOA (FOA § 20-12).

Requirement #8: Relevant experience from equivalent assignments/deliveries. Documentation requirement #8: A description of the company's most important relevant contracts in the last 5 years. The attached template shall be used (Annex 5). The reference description must include sufficient information to assess the relevance for this assignment. The contracting authority shall be able to contact the reference person.

Requirement #9: Very efficient SHA — Safety, health, working environment. Bybanen Utbygging has an expressed target of the H1 value being 0.

Documentation requirement #9: Tenderers shall give an account of how the tenderer can, in the best possible way, fulfil the builder's target of a H1 value of 0. An account of the company's SHA policy including the H1 and H2 values for all projects in the last three years. Describe the system for registering and following-up unwanted events (RUH)

Requirement #10: Environment: The work is to be done with the least possible impact on the environment, including noise, waste, emissions, energy consumption, and recycling.

Documentation requirement #10: Contractors must give an account of the company's practice/routines for the fulfilment of environmental requirements.
