Frøya kommune

Frøya municipality currently does not have satisfactory pool facilities for schools, nurseries, health services and inhabitants. The municipality would like, via this procurement, to establish a swimming facility that covers these needs over a period of 50 years. Public-private cooperation (OPS) has been chosen as the implementation model. The choice is justified by the municipality wishing to utilise private competence within engineering design, construction and long-term operation, transferring technical and financial risk to the tenderer, and freeing up municipal capital for other prioritised investments. The tenderer will be compensated through a fixed, index regulated annual rent for the entire contract period of 50 years.

Rettslig grunnlag:
Negotiated procedure after a prior notice, cf. the procurement regulations § 13-2, cf. the public procurement law dated 17 June 2016 no. 73 and the public procurement regulations of 12 August 2016 no. 974, part III. The procurement will be carried out as a negotiated procedure due to the contract ́s particular complexity, cf. § 13-2 letter c.

The petition for a provisional injunction against contract signing must be submitted to the district court at the latest 15 days from the day the contracting authority has sent notification according to the procurement regulations § 25-1, cf. the procurement regulations § 25-4. The waiting period is 10 working days.
