The Norwegian Water Resources and Energy Directorate [Norges vassdrags- og energidirektorat (NVE)] will be entering into a contract with a tenderer to assess the feasibility of relevant measures for drainage of the Åknes mountain area in Stranda municipality. An assessment must be made of how the relevant measures can be implemented technically, whether they are acceptable in terms of safety and whether they will produce the desired effect.
A digital tender conference will be held 26.09.2023 at 12. Register in Mercell no later than 24.09.2023 by sending the name and email addresses of participants. The contracting authority encourages the submission of questions in advance of the conference.

In the period 2017 to 2021, NVE conducted a knowledge project (NVE report no. 20/2021) to look at the possibility of draining surface water and groundwater from the section of unstable rock at Åknes, with the aim of reducing the risk of landslides. Based on the knowledge project, NVE has assessed that there is sufficient knowledge of the geological and hydrological conditions, and that more detailed planning should be carried out for the drainage of surface water and groundwater. The assignment in this call for tenderers is a realistic assessment of relevant drainage measures.

Beskrivelse av opsjoner:
NVE would like to have the opportunity to continue the collaboration with the consultant for the detailed engineering design of the recommended solution. In connection with this, NVE has set up two options. The options are adapted for different contract forms. Whether the options are exercised depends on whether NVE will proceed with the recommended solution, whether NVE is satisfied with the collaboration and the consultant's work in the preliminary project, and what form of contract NVE chooses for the implementation of the recommended solution (if applicable).

NVE can exercise the options within 6 months from the date the final report is submitted.
Option 1: Transport
If NVE chooses to proceed with the recommended solution as a turnkey contract, NVE will have the right to transfer the consultant to a turnkey contractor to carry out detailed engineering design of the solution.
Transport may be relevant if NVE chooses to carry out the recommended solution as a turnkey contract in accordance with NS 8407.
Option 2: Detailed engineering design
If NVE is satisfied with the consultant's work, NVE would also like the consultant to carry out the detailed engineering design of the recommended solution. The work will form the basis for a possible execution contract or further work on the concept and solution before a final choice is made regarding execution.

Before detailed engineering design work can begin, the parties must agree on the essential content of the contract. This includes items such as a plan for carrying out detailed engineering design, milestones, a progress plan with a final deadline, the fee budget and team composition.

Even if the parties have entered into a dialogue about the more detailed content of the option and the detailed engineering design, NVE will not be obliged to exercise the option if the parties do not come to an agreement. In that case, NVE will announce a separate tender contest for detailed engineering design.

REQUIREMENT: Tenderers must have their tax, payroll tax and VAT payments in order. DOCUMENTATION REQUIREMENT: A tax certificate, not older than six months, calculated from the tender deadline. Tax certificate means: For Norwegian tenderers: - Certificate for tax and VAT issued by the Tax Office via Altinn. For foreign tenderers: Foreign tenderers must attach an equivalent certificate from the country showing that they have their affairs in order regarding the payment of taxes and duties. If the authorities in the relevant country do not issue such certificates, the tenderer must enclose a declaration that states that all taxes and duties have been paid. The declaration shall be approved and signed by the tenderer´s director of finances/finance manager.

REQUIREMENT: Tenderers must be a legally established company. DOCUMENTATION REQUIREMENT: Norwegian tenderers:
* Company Registration Certificate.
Norwegian tenderers are not required to submit a company registration certificate with the tender. The contracting authority will obtain a company registration certificate itself for Norwegian tenderers from the Brønnøysund Register Centre.
Foreign tenderers:
* Confirmation that the tenderer is registered in a trade register or company register in accordance with the law in the country where the tenderer is established.

REQUIREMENT: Tenderers must have sufficient financial strength to be able to fulfil the contract. DOCUMENTATION REQUIREMENT: The tenderer´s Annual Financial Statements, including notes and the board and auditor´s reports from 2021 and 2022. Norwegian tenderers are not required to submit Annual Financial Statements with the tender offer. For Norwegian tenderers, the contracting authority will obtain Annual Financial Statements itself from the Brønnøysund Register. The contracting authority reserves the right to obtain a credit rating from Experian. Financial strength will be evaluated in relation to turnover, operating profit margin, solidity and liquidity.

Teknisk og faglig kapasitet:
REQUIREMENT: Tenderers must have sufficient implementation ability to fulfil the contract.
DOCUMENTATION REQUIREMENT: A short and general description of the activities must be enclosed, including:
*A description of ongoing and planned deliveries
*A description of the tenderer's average annual labour force
*Overview of personnel within different categories such as Consulting construction engineer (RIB), Consulting geotechnical engineer (RIG) and similar
REQUIREMENT: Tenderers must have good experience from relevant and comparable deliveries. Relevant and comparable deliveries means assignments involving tunnels, landslide risk, hazard zone maps and hazard zone assessments, or regulation and assessment of environmental impacts. As a general rule, reference projects should involve several of the disciplines in order to be recognised as relevant and comparable. DOCUMENTATION REQUIREMENT: A description of up to 3 of the tenderer's most relevant and comparable assignments from the last 3 years. It is, however, the tenderer´s responsibility to document relevance through the description. Tenderers can document experience be referring to the competence of the personnel that can be used for this assignment, even if the experience was acquired while the personnel was in the service of another employer. Tenderers must document fulfilment by completing the attached template for reference descriptions, see Annex 10 Reference Descriptions. The description should not exceed 1 A4 page for each of the assignments.

REQUIREMENT: Tenderers must have a documented and implemented satisfactory quality assurance/management system adapted to the complexity, risk and objectives of the delivery. DOCUMENTATION REQUIREMENT: A brief description of the tenderer's quality assurance/management system and methods for quality assurance. The description must nevertheless be sufficiently detailed to enable the Contracting Authority to make an independent assessment of whether the Tenderer's quality assurance/management system is well-functioning for the current contract. NVE would like to have moglegheit to conduct the cooperation with the consultant for the execution of detailed engineering design of the recommended licence. Nve has set up two options for this. The options are adapted to different contract forms. Whether the options are lied out depends on whether NVE will go vidare with the recommended licence, whether NVE is now with the cooperation and the consultant's work in the preliminary project, and what contract form NVE well for the execution of the recommended lying (if this becomes relevant). NVE can extend options for 6 months from the date the final report is submitted. Option 1: Transporting NVE well to go vidare with the recommended licence as a turnkey contract, NVE will have the right to transport the consultant to the turnkey contractor to carry out detailed engineering design of the licence. The transfer can be relevant if NVE shall carry out the recommended licence as a turnkey contract in accordance with NS 8407. Option 2: Detailed engineering design If NVE is with the consultant ́s work, NVE would like the consultant also to carry out the recommended detailed engineering design services. The work will form the basis for any execution contract or additional work with concept and licences before the end of the implementation host. Before detailed engineering design work can be undertaken, partane saman must agree on what is being agreed to in the contract. This includes points such as plans for detailed engineering design services, milestones, progress plan with final deadline, fee budget and team administration. Even if the parties have had a dialogue about whether there is an agreement in the option and the detailed engineering design services, NVE will not be obliged to lick out the option if the parties do not agree. NVE will, in such cases, go out with a separate competition for the detailed engineering design services. A guideline for the option being extended is that NVE did not carry out a turnkey contract as a result of the recommended licence.
