The Norwegian Public Roads Administration would like to enter into a framework agreement with two tenderers for the provision of legal services within the legal areas construction law and contract law, public procurements and legal advice within real estate. The framework agreement shall apply for the Norwegian Public Roads Administration as the agency, and call-offs can apply to all divisions in the Norwegian Public Roads Administration and the Directorate of Public Roads. The objective of the framework agreement is to cover the need for legal services where the Customer/Attorney General does not have the capacity or for other reasons cannot or would like to undertake the assignment.

Compliance with the Sanctions Regulations of Ukraine. According to the regulation on restrictive measures regarding actions that undermine or threaten Ukraine's territorial integrity, sovereignty, independence and stability (The Sanctions Regulations of Ukraine (territorial integrity etc.)) § 8n, it is forbidden to award, or continue the implementation of public contracts above the EEA threshold value of, and with, Russian actors. Tenderers shall not be a unit that is under the ban in the Sanctions Regulations of Ukraine (territorial integrity etc.) § 8n. Documentation requirement: Tenderers shall confirm that they fulfil this requirement when submitting their tender. The contracting authority has the right to carry out the investigations that are necessary to ensure fulfilment of the sanctions regulations in the competition implementation and in the contract period. Tenderers shall, upon request from the Contracting Authority, assist in the work and present relevant documentation that enables the Contracting Authority to assess whether the Tenderer is affected by the ban.

Tax certificate. Tenderers shall have their tax, payroll tax and VAT payments in order. Documentation requirement: Tenderers shall confirm that they fulfil this requirement when submitting their tender. Tenderers shall present a tax and VAT certificate issued by a competent body in the tenderer's home country or the country where the tenderer is established. The certificate shall show whether the tenderer has fulfilled his obligations to pay taxes, duties and social security contributions. The certificate shall not be older than six months from the tender deadline. If a request for participation in the competition is to be submitted, the certificate must not be older than six months calculated from the deadline for submitting the enquiry.

Tender letter. Documentation requirement: Tenderers shall submit a tender letter, cf. the template for a tender letter that is attached to this tender documentation.

Tenderers must have sufficient financial capacity to fulfil the contract. In order to fulfil the requirement, it is sufficient for the tenderer to be assessed as credit worthy based on Experians Commercial Delphi score. If a tenderer is assessed lower than credit worthy, the contracting authority can undertake an overall assessment based on additional information. The contracting authority will obtain a credit rating from Experian. If there is doubt, the Contracting Authority can obtain further information from the tenderer.

Documentation requirement: Tenderers shall confirm that they fulfil this requirement when submitting their tender. Tenderers shall present the following documentation: - An overview of five of the most important, relevant work carried out in the last 3 years, including a short description of the assignment, the name of the public or private recipient, as well as information on value/quantity/scope and date. Tenderers are encouraged to use the template in "Annex 1 - Assignment List". It is not a requirement that each individual reference assignment covers all the areas, but the tenderer must, through the submitted reference assignments, document experience in total that covers the central works that are relevant for this procurement. A tenderer who is newly established and cannot submit references, must be particularly careful to document and substantiate that they still have the prerequisites required to carry out the assignment. Relevant assignments means process and consultancy assignments of a size and complexity that the Norwegian Public Roads Administration has in its portfolio.

Documentation requirement:

Tenderers shall confirm that they fulfil this requirement when submitting their tender.

Tenderers shall present the following documentation:

- An overview of five of the most important, relevant work carried out in the last 3 years, including a short description of the assignment, the name of the public or private recipient, as well as information on value/quantity/scope and date.

Tenderers are encouraged to use the template in "Annex 1 - Assignment List".

It is not a requirement that each individual reference assignment covers all the areas, but the tenderer must, through the submitted reference assignments, document experience in total that covers the central works that are relevant for this procurement.

A tenderer who is newly established and cannot submit references, must be particularly careful to document and substantiate that they still have the prerequisites required to carry out the assignment.

Newly established tenderers can document that the requirement is fulfilled by referring to experience that the offered persons/resources have built up in the service of others than the tenderer.

Tenderers shall have resources with competence and experience within real estate and questions related to tax and duties in connection with. real estate. Documentation requirement: Tenderers shall confirm that they fulfil this requirement when submitting their tender. Tenderers shall, upon request from the Contracting Authority, present the following documentation proof: - An overview of 3 of the most important, relevant work carried out in the last 3 years, including a short description of the assignment, the name of the public or private recipient, as well as information on value/quantity/scope and date.

In addition to the documentation that the tenderer has submitted, the contracting authority will emphasise its own documented experience with the tenderer.

Support from other entities. Tenderers can, if necessary, rely on other companies' capacity to fulfil the requirements for economic and financial capacity and/or the requirements(s) for technical and professional qualifications. Documentation requirement: Tenderers shall submit the following documentation: • If the tenderer will use the capacity of other companies to fulfil the requirements(s) for economic and financial capacity, a declaration of joint and several liability to the contracting authority must be enclosed. • If the tenderer will use the capacity of other companies to fulfil the requirements(s) for technical and professional qualifications, each company shall submit a commitment statement or equivalent which documents access to the necessary resources. The commitment statement shall state which disciplines are available. Tenderers are encouraged to use a template for a commitment statement that is attached to this tender documentation. If a tenderer will use the capacity of other companies to fulfil the requirements of relevant experience, these entities shall carry out the services or the building and construction work that requires such qualifications.

Participation in communities. Several tenderers can participate in the competition jointly. The community must see to the necessary documentation that all the qualification requirements are met. Tenderers who participate as a working partnership will be assessed collectively for the qualification requirements of economic and financial capacity and technical and professional qualifications. Documentation requirement: Tenderers shall submit the following documentation: • An account of the (work) community, including the role of each participant. • Each individual entity in the (work) group shall submit a tax certificate. • In order for the working partnership to be assessed collectively, commitment statements or equivalent must be presented between the tenderers who will use the capacity of other participants in the group. • Declaration of joint and several liability to the contracting authority. If a tenderer will use the capacity of other companies to fulfil the requirements of relevant experience, these entities shall carry out the services or the building and construction work that requires such qualifications.
