The purpose of the procurement is to contract an engineering design team to carry out the following works:
- Zoning plans for Bildøyna
- Outline design of a new Fjell secondary school and temporary additional area at the current Fjell secondary school
- Option for preliminary design of the new Fjell secondary school
- Option to transport ARK, LARK and/or IARK
- Option for assistance from ITB management during the construction and warranty phases
It has not yet been decided whether the project will be implemented as a turnkey contract or a PPP.
NS 8401 applies as the contractual terms and conditions with the amendments and additions set out in the contracting authority's contract documents. The work will be remunerated based on time and materials, and the tenderer must provide a fee budget as part of the tender.

The contract includes an option for preliminary engineering design, an option for the delivery of ARK, LARK and IARK and an option for assistance from the ITB manager during the construction and warranty phases.
There is a high probability that the preliminary engineering design option will be utilised. The reason for preliminary engineering design being listed as an option is that a final decision has not yet been made regarding whether the project will be carried out as a turnkey contract or a PPP. The municipality therefore wishes to retain flexibility with regard to the preliminary engineering design.

Requirement: Tenderers must be registered in a company register, professional register or a trade register in the country where the tenderer is established.
Documentation: Norwegian tenderers: Company Registration Certificate Foreign tenderers: Confirmation that the tenderer is registered in a company register, professional register or trade register in accordance with the law in the country where the tenderer is established.

Requirement: Tenderers must have sufficient economic and financial capacity to be able to fulfil the contract. The required financial capacity will be assessed in relation to the contract's value, services, risk and length.
Documentation: A credit rating based on the most recent financial figures. The rating must be carried out by a credit rating company with licence to conduct this service.
Requirement: Tenderers must have good experience from equivalent assignments in the last 3 years. The requirement that the tenderer have good experience from equivalent assignment includes a requirement for the tenderer to demonstrate experience with:

Documentation: Description of the tenderer's most relevant assignments in the last 3 years. The description must include information on the value of the assignment, date and recipient. Tenderers must use the reference form in Annex 5.
Requirement: Tenderers must have good routines for quality management.
Documentation: Documentation must be provided in one of the following ways:
Alternative 1: Description of the company's procedures regarding quality management, with emphasis on quality assurance, resource management, management responsibility and continuous analysis and improvement.
Alternative 2: If a tenderer holds an ISO 9001:2000 certificate or equivalent, this can be enclosed.
Vilkår for kontraktoppfyllelse:
The contractual relationship is governed by NS 8401 with the amendments and additions in the contracting authority's contract documents. The work will be remunerated according to the number of hours worked. Tenderers must provide a fee budget as part of the tender.

Background for the cancellation:
The background for the cancellation is that the contracting authority has found, after an assessment, that the award criteria are not suitable to nominate the tender with the best relationship between price and quality. According to the point 8.1 of the tender documentation and the price sheet, the award criterium 'price' should have been assessed on the basis of the tenderer's fee budget for the assignment.
The contracting authority has been made aware of KOFA case 2019/370, where the fee budget was assessed as an illegal award criterium, which meant that the contest should have been cancelled.
The reason for the award criterium being seen as unsuitable for nominating the tender with the best relationship between price and quality, is that the assignment will be carried out as daywork according to the time used. The chosen tenderer will therefore, as a starting point, be paid for all the hours used even if they exceed the fee budget stated in the tender. The tenderers' estimated number of hours is therefore not binding or necessarily the same as what price the contracting authority will actually have to pay for the service. As such a fee budget is not contractually binding, the award criterium is thus seen as not suitable to nominate the best relationship between price and quality.
The error can influence participant interest and the outcome of the contest, so the assessment is that there is a 'justifiable reason' to cancel the contest, cf. the PPR § 25-4.
