Kvalitetskriterium (navn): The contracting authority has concluded that the exclusion provisions in § 7-9(4) can be used for occasional needs for bus transport, and that it is "clear" that a minimum requirement for zero emissions in the requirement specifications provides better climate and environmental effect than evaluation with 30 % weighting. Below follows the reasoning.  Grounds  Occasional need for bus transport typically involves shorter trips within or near the Region of Drammen, with sufficient planning time so that the tenderer can use suitable materials. Market surveys show that a sufficient number of suppliers in the region have access to zero emission buses that are suitable for this type of assignment, and that the driving distances are normally well within the range of electric buses on the market today. The minimum requirement is therefore feasible and proportional.  As the assignments occur continuously and are not known at the time of the tender, tenderers cannot commit specific buses to specific assignments in their tender offer. It is only with each order that the tenderer knows the character of the trip and choose which bus shall be used from their available fleet. An award criteria with 30% weighting on the estimated share of zero emission driving would therefore force tenderers to estimate a percentage without knowledge of the assignments' nature, length or time. This increases the risk of bids with optimistic estimates winning the competition without matching the actual environmental performance. The requirement would also be difficult to evaluate and follow-up in practice.  A minimum requirement for zero emissions solves this challenge by ensuring that zero emissions are the main rule independent of which bus the tenderer can use for each assignment, except only in clearly defined cases. The actual environmental effect will be considerably higher and more predictable than on a relative point scale. The requirement is also easier to follow-up, as the assessment only becomes if a concrete assignment falls within an exception.  The market dialogue shows that most suppliers can deliver Euro 6 standards, and several can deliver electric buses. By choosing a minimum requirement for Euro 6 for the exception cases, high environmental ambitions can therefore be combined with real competition and feasibility for the supplier market.  All buses used for occasional need for bus transport shall be zero emission vehicles. The following exceptions apply:  1. Missing charging infrastructure: If the length of the trip and the expected accompanying route choices indicate that sufficient charging infrastructure is not available.  2. Weather conditions: If the weather conditions indicate that the zero emission bus will not arrive in a proper manner.  3. Total environmental assessment: If the total transport need suggests that it would be more environmentally friendly to use one larger bus rather than two or more smaller zero emission buses.  If one of these exceptions is applicable, the tenderer shall offer buses with a minimum of Euro VI. It is the tenderer who carries the burden of proof that an exception is present. Tenderers shall give the contracting authority a justifiable and verifiable justification for why the zero emission requirement cannot be fulfilled, with reference to the relevant exception documentation. The contracting authority reserves the right to review the tenderer ́s justification.
