The framework agreement will be valid for 2 years, with an option for an extension for 1+1+1 year, total 5 years.
The justification for a contract period of 5 years is i.a. connected to the contract ́s purpose and the components ́ maintenance cycle. During a five year period, among other things, a fleet will carry out replacements of various components based on annual condition evaluations. Some components can be replaced in year 2, others in years 3 or 4, but they must all be replaced within a five year period. The tenderer prices the deliveries based on this total life cycle.
If the framework agreement is terminated after 4 years, the replacement cycle will in many cases not be completed. The cost and execution risk for the remaining replacements will then be transferred to the new supplier. The new supplier must price in uncertainty connected to components that, according to the plan, should have been replaced within the previous contract period. This risk transfer will result in increased prices and make the contract disproportionately expensive for what is in itself a contract value of a relatively low sum.
The experience from the previous contract period supports that the extent of the deliveries follows natural replacement cycles and not an artificial limit of four years. A 5 year contract period improves economic predictability, reduces risk mark-up and ensures general execution of the replacements.
A five year period also gives a better connection and synergy to the company's security management system (ISM), which is monitored by the Norwegian Maritime Authority, by allowing maintenance, replacements and documentation to be planned and carried out in a combined cycle.
Based on this, particular conditions are being made regarding the purpose of the contract, the nature of the deliveries and the financial consequences of shortening, which together justify a duration of five years in accordance with the exclusion provisions in PPR § 11-1 (4).
