The contracting authority has concluded that the use of minimum requirements gives a clearly better climate and environmental effect than the use of award criteria, and has therefore utilised the exemption provision. This is justified and documented in the procurement documents. The exclusionary provision in the public procurement regulations § 7-9 fourth paragraph of the first period will therefore be used in this procurement.
