Prior to signing of the contract, the tenderer can directly contact the contracting authority with a request to reconsider , and possibly alter, a decision on rejection, cancellation of the competition, award of contract, etc.
The waiting period deadline will be set in the award letter. The waiting period will be minimum 10 days.
The Appeals Board for Public Procurements (KOFA) is an independent appeals board. KOFA is intended to be a quick and reasonable appeals option at a lower conflict level than the law courts. Tenderers can freely choose to appeal to KOFA or to go directly to the courts or to ESA.
Before the contract is signed, the tenderer can go to the court and petition for a temporary injunction that prohibits the contracting authority from entering into a contract until it is decided whether the procurement regulations are breached, cf. the Procurement Act §§ 8 and 9.
