The contracting authority invites tenderers to apply for a service concession for the practical assistance service, organised as user-controlled personal assistance (BPA). The user controlled personal assistance (BPA) service is provided in accordance with: - The Health and Care Services Act § 3-8 User controlled personal assistance: The municipalities shall have offers of personal assistance in accordance with § 3-2 first section no. 6 letter b, in the form of practical assistance and training, organised as user-controlled personal assistance. - The Patient and User Rights Act § 2-1 d. Right to user controlled personal assistance. The contracting authority is obliged to procure BPA services with the service providers that have been awarded a service concession contract with. Each BPA user ́s choice will decide which supplier(s) the contracting authority will order BPA services from. Tenderers are obliged, according to orders, to provide the services within the limits of applicable laws and rules, the municipalities ́ individual decisions on BPA and the attached contract. As of April 2025, a decision has been made on services of a total of 666.5 hours weekly divided between 9 users. The procurement will be made in accordance with the Act from 17 June 2016 no. 73 on public procurements (the Procurement Act) and regulations 12 August 2016 no. 976 on concession contracts parts I and III. The contracting authority plans to award service concession contracts without having a dialogue with tenderers beyond any clarifications/corrections.

Tenderers shall be a legally established company. Documentation: Company Registration Certificate
Tenderers shall have good conduct. The applicant must not be pleaded guilty to criminal offences related to professional conduct, or in his profession, plead guilty to serious misconduct against professional and ethical requirements in the branch. The applicant must not have carried out systematic violations of the Working Environment Act. Documentation: The applicant shall present a self-declaration confirming that the requirement is fulfilled, see annex 2.

Tenderers must have sufficient financial capacity to fulfil the contract. Documentation: A solidity assessment from a certified credit rating company based on the last known accounting figures. If the figures for the last year have not been finalised at the time of the application deadline, tenderers are requested to enclose provisional accounting figures for the same year. The contracting authority can free of charge undertake an assessment of the tenderer's economic and financial position. Recently established companies can enclose a bank guarantee, or equivalent documentation from a bank. If a tenderer, due to valid reasons, cannot submit the documentation requested by the Contracting Authority, he can prove his economic and financial position with another document accepted by the Contracting Authority.

Experience: Tenderers shall have experience from equivalent contracts/assignments. Equivalent assignments mean the operation and management of BPA schemes. Documentation: Overview of services performed in the last three years, see Annex 3 Reference Form. The overview shall as a minimum contain: - Name of the customer - Contract value and scope - Date of the delivery. - Brief description of the delivery. The description may include information on the tenderer ́s individual contracts with users of the BPA scheme. Newly established companies must document the employees' experience in the same way. The contracting authority reserves the right to contact the stated references.

After the choice of tenderer(s) has been made, all involved tenderers will be informed in writing of this. Tenderers who have submitted an application by the deadline and who fulfil the conditions for obtaining a service concession for the BPA and the minimum requirements in this basis, will be granted a licence to offer the service to Kvinesdals municipality ́s inhabitants. Applicants who are not granted a licence will receive written feedback on the basis of the rejection of the application with a deadline for appealing the decision.
