The procurement will be carried out as a negotiated procedure after a prior notice. The procurement will be carried out as a negotiated procedure after a prior notice. The competition concerns health and social services, and follows the law on public procurements of 17 July 2016 no. 73 (the Procurement Act) and the public procurement regulations of 12 August 2016 no. 974 (the procurement regulations) parts I and IV. The contracting authority reserves the right, however, not to hold negotiations and award the contract based on the originally submitted tender. Tenderers are therefore encouraged to stretch and submit their best tenders ahead of the tender deadline. The aim is to carry out one round of negotiations, but the contracting authority reserves the right to carry out several rounds of negotiations. Tenderers must be prepared to reduce the number of tender offers that are negotiated during the negotiations. The number of tenders can be reduced before the first round of negotiations. Such a reduction may be made on the basis of the award criteria. All tenderers that are negotiated will be able to submit revised tenders within a further set deadline. The negotiations can apply for all sides of the submitted tenders, both parts of the tender that can be improved and parts of the tender that the contracting authority would like to have clarified. Significant reservations and deviations from the tender documentation in the final tender will lead to the tender being rejected. Although it is possible, tenderers cannot reckon that the contracting authority will be able to withhold reservations and deviations as part of any negotiations.
