The contracting authority needs to procure a parallel framework agreement with up to two (2) tenderers for covering 24 hour residential and welfare services for users with resource demanding services in Sandnes kommune, provided that there are two (2) suitable tenderers and tender offers. The service is pursed in the Act 24 June 2011 no. 30 on municipal health and welfare services; • § 4-1 on prudence § 3-1 on the municipality ́s overall responsibility for health and care services. • 3-2 no. 6 letter c. place in an institution, including a nursing home. Act 2 July 1999 no. 63 on patient and user rights; § 2-1 on the right to necessary help from the municipality ́s health and welfare service. as well as special legal basis, including legal judgement from the courts. The service is awarded to adult users with a large and complex facilitation need with different types and intensity of disabilities such as, for example, but not limited to mental disabilities, mental disorders, physical disabilities, developmental disturbances, challenging behaviours or a combination of them. The contracting authority draws attention to the fact that in some cases users with drug and alcohol challenges can present. The framework agreement also applies for individual users with special needs as far as applicable. Special needs can include medicament challenges, infectious considerations and a need for special competence etc. In cases where the special need does not fit the framework agreement, the contracting authority reserves the right to procure services outside the contract. The aim of the procurement is to ensure users quality approved services when the contracting authority does not have the capacity to meet the needs of self-management. Returning to the municipality is a general goal and the tenderer shall actively contribute in facilitating the return. The extent of the framework agreement can, therefore, vary considerably from year to year.

Hovedtrekk ved prosedyren:
The procurement will be made in accordance with the Public Procurement Act of 17 June 2016 (LOA) and the Public Procurement Regulations (FOA) dated 19 February 2020 no. 974. Parts II and IV of the regulations apply for this procurement, the procurement of health and social services. The competition is based on an open tender contest, cf. the Public Procurement Regulations § 8-3. The contracting authority plans to award the contract without having a dialogue with the tenderers beyond making any clarifications/corrections. Dialogue through negotiations can, however, be carried out if the contracting authority, after the tenders have been received, considers it appropriate. The selection will, in such cases, be made after an assessment of the award criteria. Emphasis is put on the fact that no tenderers can expect a dialogue on their tender and must, thus, submit their best tender. Furthermore, attention is agreed that tenders that include significant deviations from the competition documents shall be rejected in accordance with the Public Procurement Regulations § 9-6 (1) b). The contracting authority can reject tenders that include deviations from the procurement documents, uncertainties etc., which must not be considered insignificant, cf. the Public Procurement Regulations § 9-6 (2) cf. § 24-8 (2). Tenderers are therefore strongly encouraged to follow the instructions given in this tender documentation with annexes and possibly to question uncertainties through EU Supply to the contracting authority's gender neutral preferred.

Qualification requirement: Tenderers must not have significant tax and VAT arrears, or an approved repayment plan shall be in existence. Documentation requirement: Tax certificate, not older than 6 months.
Qualification requirement: Tenderers must have sufficient economic and financial capacity to fulfil the contract. Tenderers must achieve a minimum rating of "Credit worthy". Documentation requirement: When submitting their tender offer, tenderers shall enclose a credit rating from a certified credit rating company that shows that the tenderer fulfils the requirement for credit worthiness. The credit assessment shall be based on the last available accounting system, and it shall be carried out by a company with licence to carry out credit information activities. If a tenderer has a justifiable reason for not submitting the documentation required by the contracting authority, he can document his economic and financial capacity by presenting any other document that the Contracting Authority deems appropriate. The contracting authority will also obtain a credit rating from Commercial Delphi Score from Experian (the contracting authority subscribes to services from Experian). The credit ratings will be seen in connection with assessments of fulfilment of the qualification requirement.

Qualification requirement: Tenderers shall have experience and competence from assignments of a relevant nature, scope and complexity. Documentation requirement: Documented by enclosing a list of the three most important, relevant assignments in the last 5 years, including information on: - What the assignment included - Time frame of the delivery - Nok 100,000,0 - Reference person (name, telephone number and email address). Tenderers shall fill in "Annex 5 - Reference Assignment". Tenderers can document their experience by referring to competence of the personnel he has at his disposal and can use this assignment, even if the experience has been worked up while the personnel have served another service provider.
