Gran kommune
Gran municipality invites tenderers to an open tender contest for a framework agreement for occasional hire of crews, site machines, lorries, rigging and equipment. We would like to enter into a framework agreement with up to three actors in order to ensure availability. The executing companies will be ranked according to the surging method. Tenderers shall substantiate the financial capacity to fulfil the framework agreement. Tenderers shall enclose proof that they are credit worthy AA. Annexes and responses shall be added here.

Compulsory occupational pension: Mandatory occupational pension requirement The tenderer is responsible for ensuring that their own employees, sub-contractors employees (including hired) who directly contribute to the framework agreement, have compulsory occupational pensions (OTP) in accordance with the Compulsory Occupational Pension Act. All contracts that the tenderer signs for the execution of work under this framework agreement shall include equivalent provisions. The tenderer is obliged, upon written enquiry, with a reasonable deadline to document that all workers who contribute to the framework agreement and who fall under a compulsory occupational pension scheme are registered in such a scheme. The documentation can include a copy of a signed contract with a pension scheme that shows that the tenderer and/or sub-suppliers have entered into a valid agreement on the OTP scheme as well as documentation, for example in the form of invoices etc., which shows that employees who directly contribute to the framework agreement are registered in the OTP scheme. If there is a breach of the documentation obligation, the contracting authority has the right to impose a day fine that shall not be less than NOK 1500 per day. If there is a breach of the requirement for compulsory occupational pension, the tenderer shall correct the situation. The contracting authority has the right to retain an amount equivalent to approx. twice the savings for the tenderer. The retention right ceases as soon as the a correction in accordance with previous paragraph is documented. Significant breaches of the requirement for compulsory occupational pension, including the documentation obligation, can be pleaded by the contracting authority as a basis for cancellation, even if the tenderer corrects the conditions. If the breached occurred in the sub-supplier chain (including manpower companies), the contracting authority can demand that the tenderer replaces the sub-supplier. This shall be carried out at no cost to the contracting authority.

Supplier Register: Tenderers shall provide StartBANK ID or enclose a copy of registration certificate from StartBANK or equivalent supplier register that contains updated and controlled supplier information.
Apprentices: Tenderers are required to be affiliated with an apprenticeship scheme and that an apprentice participates in the work of fulfilling the contract, cf. the regulations on obligation to set requirements on the use of apprentices in public contracts. Tenderers shall submit documentation proving that they are connected to such an apprenticeship scheme.

Tenderers shall document that they have central certification or are qualified to declare the right to be responsible. Documented competence shall be as stated in SAK chapter 11, in the following disciplines and development classes for execution (UTF):
• Surveying and protruding of initiatives in development class 2
• Road and ground works in development class 2
• Water supply and sewage installations in development class 2.

Tenderers must also document education, certificates, courses that each employee may have offered for work on the framework agreement. Beyond the necessary certificates and courses that are statutory that the tenderer shall hold for work that shall take place under the framework agreement, personnel shall be documented with an ADK certificate and a certificate for mirror and electro suffix welding of plastic pipes. Personnel/employees ́ education, certificates, courses etc. shall be documented with a clear list. The contracting authority can require this documentation presented for each course certificate, etc.
