Exception from requirement to use Environment as the award criteria: Justification for the environmental criteria in the contract/competition: Climate and environmental requirements in the requirement specifications - FOA § 7-9, 4 paragraph. In this procurement, the Contracting Authority has chosen to emphasise climate and environmental requirements by drawing this in as a separate requirement in the requirement specifications - "Environmental requirements in the contract". This is stated in both the procurement protocol and the competition notice. Due to the tender covering cleaning services, cleaning chemicals and transport of them, as well as follow-up from the tenderer, will be subject to climate and environmental requirements. All of these points shall be well incorporated into the cleaning industry, with ISO certification, including waste management (Green Point), requirements for swan labelled products, etc. In addition, a lot of cleaning shall be carried out without the use of chemicals, and with little water, and this is also well incorporated in the industry, with new innovative systems for cleaning. It would then be better to have as a minimum requirement on environmental requirements that all the supplier uses of chemicals shall be swan ecolabel etc. In addition we have requirements for ISO certification within environmental management and waste management (Grønt Punkt). Furthermore, there is an authority requirement from 1.1.2024 that there shall be fossil free transport in all public contracts. Asker municipality has, in addition to an agreement with the County municipality, undertaken to set environmental requirements in public procurements. Summarised this means that the contracting authority has, as a minimum requirement in the competition, both requirements for ISO certification on environmental management, including waste handling/Grønt Punkt, requirements for the use of chemicals that are swan labelled or equivalent, as well as requirements for only the use of emission-free vehicles. If these requirements are instead added as award criteria, we risk bringing in tenderers who do not fulfil the environment requirement because they win at the end of the price, and it will be difficult to follow-up the environmental requirements in the contract period. Asker municipality therefore considers that the total effect of environmental achievement will be better by setting this as a minimum requirement in the qualification requirements than by having it included in the terms for awarding of contract. Our assessment is that the use of emission-free vehicles, as well as the special environmental requirements for the cleaning industry, together, will give a clearly better climate and environmental effect. By making an absolute requirement - which we also find that possible tenderers have largely adapted to by using/being able to offer emission free vehicles for this type of assignment - we easily ensure a better environmental effect. In accordance with PPR § 7-9, 4th paragraph, it is possible to adapt as this is done , provided that information is given in the procurement documents - which is safeguarded here.
