The provision has a "follow or explain" principle. This means that the contracting authority must either follow the main rule on 30% weighting the environment or explain why the main rule is not adhered to.
Two exceptions from the main rule for weighting the environment of 30% as the award criteria have been set in 4 and 5 links. The exception from the main rule on thirty percent weighting must be justified in the procurement documents:
4th link: The environmental award criterion can replace with climate and environmental requirements in the requirement specifications if this gives a better climate and environmental benefit.
5th part: The contracting authority shall not evaluate the environment for procurements that have an "immaterial climate footprint and environmental impact".
In this procurement there will be requirements for the environment that clearly give a better effect than evaluating the environment and climate.
Meetings and assignments that are carried out with light vehicles shall be held with electric vehicles. The requirements that are set forth are Euro class 6/VI and bio-fuel for heavy vehicles. In the segment of vehicles included in the service, Euroklasse 6/VI and the requirement for bio-fuels for better climate and environmental effect than an evaluation could have been done. This is because there is only one electric vehicle in some of the categories, and the delivery time for new vehicles is longer than half the contract period. This has become apparent through market surveys. Thus, the requirements will clearly give a better climate and environmental effect than carrying out the evaluation, cf. The Public Procurement Regulations § 7-9 fourth section.
