Justification for using the exclusionary procurement regulations § 7-9 (4):
The Norwegian Government Agency for Management and Financial Management (DFØ) has an overview of the climate and environmental impact of different CPV codes at the main level: the climate and environmental risk list (https://anskaffelser.no/berekraftige-anskaffingar/klima-og-miljo/klima-og-miljorisikolisten).
For CPV-code 33 (Medical equipment, medicines and equipment for personal care), the climate and environmental impact in the life cycle perspective is given to be the following: extraction of raw materials and production that results in pollution, reduced diversity of nature and overuse of scarce resources. It is demanding for the contracting authority to identify measures that affect in this phase and the best way to influence the environmental impact will therefore be to reduce the need for extraction and production.
Based on this, our assessment is that it is clear it provides a better climate and environmental effect with requirements for packaging and recycling, environmental accounts, reuse and reuse, strategy for improving greenhouse gas emissions, the highest possible degree of recycling in final treatment of batteries as well as the absence of hazardous substances than the use of the award criterion. The exclusion provisions in the Procurement Regulations (FOA) § 7-9 (4) will therefore apply.
Reasons for a 6 year contract period:
The basis for an extended contract period is justified by the fact that this is critical equipment that shall be handled by large employee groups in seven different intensive care departments at two hospitals. In addition the equipment is used during various interventions of anaesthesia personnel with patients in general anaesthesia.
The equipment is demanding in use simultaneously with complex treatment situations for both adults, children, newborns and especially small premature babies. Key personnel attend rota and duty schemes, which makes it very challenging to set aside time for training and that this is treatment that most employees must be able in all involved departments.
The extended contract period will be able to quality assure sufficient training of these large employee groups as well as quality assure 24 hour correct handling of equipment and consumables, with thereby reductions of errors and deviations. It is also noted that errors in the treatment must not occur, as an outcome for incorrect use can be fatal and at best critical.
Employees ́ knowledge of and knowledge of the equipment, are directly connected with both training and quantity training; in basic knowledge, in connection with the different respirators and anaesthesia apparatuses, and with "troubleshooting". Quantity training requires both time and patients with this treatment, and this is essential for maintaining and increasing patient safety in general and especially in critical patient situations where the margins are very small and the time factors are decisive.
A contract period of six years will, due to these reasons, be necessary for patient safety.
A share of the market has responded with positive attitude to a six year contract period and justifies high investment costs. High investment costs for the market will be connected to the speciality for equipment for medical treatment with NO-gas. In Norway, this type of medical treatment is mainly limited to Oslo University Hospital, as it is very special and resource intensive.

Based on this, our assessment is that it is clear it provides a better climate and environmental effect with requirements for packaging and recycling, environmental accounts, reuse and reuse, strategy for improving greenhouse gas emissions, the highest possible degree of recycling in final treatment of batteries as well as the absence of hazardous substances than the use of the award criterion. The exclusion provisions in the Procurement Regulations (FOA) § 7-9 (4) will therefore apply.
Reasons for a 6 year contract period:
The basis for an extended contract period is justified by the fact that this is critical equipment that shall be handled by large employee groups in seven different intensive care departments at two hospitals. In addition the equipment is used during various interventions of anaesthesia personnel with patients in general anaesthesia.
The equipment is demanding in use simultaneously with complex treatment situations for both adults, children, newborns and especially small premature babies. Key personnel attend rota and duty schemes, which makes it very challenging to set aside time for training and that this is treatment that most employees must be able in all involved departments.
The extended contract period will be able to quality assure sufficient training of these large employee groups as well as quality assure 24 hour correct handling of equipment and consumables, with thereby reductions of errors and deviations. It is also noted that errors in the treatment must not occur, as an outcome for incorrect use can be fatal and at best critical.
Employees ́ knowledge of and knowledge of the equipment, are directly connected with both training and quantity training; in basic knowledge, in connection with the different respirators and anaesthesia apparatuses, and with "troubleshooting". Quantity training requires both time and patients with this treatment, and this is essential for maintaining and increasing patient safety in general and especially in critical patient situations where the margins are very small and the time factors are decisive.
A contract period of six years will, due to these reasons, be necessary for patient safety.
A share of the market has responded with positive attitude to a six year contract period and justifies high investment costs. High investment costs for the market will be connected to the speciality for equipment for medical treatment with NO-gas. In Norway, this type of medical treatment is mainly limited to Oslo University Hospital, as it is very special and resource intensive.
