The contracting authority needs to procure a parallel framework agreement for the purchase of temporary staff services for schools, before-and-after-school care and nurseries in Sandnes municipality. The objective of the agreement is to ensure the contracting authority access to qualified personnel for sick leave, retirement of holidays and leave. All municipal schools and nurseries are included in the contract, but some will use the services to a greater extent than others. The need for temporary staff services applies primarily to shorter periods at a time, but temporary staff can also be needed for long periods. The contracting authority is uncertain about the extent of the procurement, but estimates an annual contract value of between NOK 3,000,000 - NOK 4,000,000 excluding VAT. This gives a total contract value for the entire contract period, including options, of NOK 12,000,000 - NOK 16,000,000, excluding VAT. Emphasis is put on the fact that this is only an estimate and is not binding for the contracting authority or rights for the tenderers. Based on the estimated value of the contract, the contracting authority has stated the maximum contract value, c.f. the Court of Justice's case C-23/20. The maximum contract value is + 15% above the estimated value. The total maximum value is approx. NOK 18,400,000 excluding VAT.

Hovedtrekk ved prosedyren:
The procurement will be made in accordance with the Public Procurement Act dated 17 June 2016 no. 73 (LOA) and the Public Procurement Regulations (FOA) dated 12 August 2016 no. 974 parts I and part III. The contract will be awarded in accordance with the open tender contest procedure, cf. the Public Procurement Regulations §13-1 (1). Negotiations are not allowed in this competition. Tenders cannot, therefore, be changed after the tender deadline has expired. Furthermore, attention is agreed that tenders that include significant deviations from the procurement documents shall be rejected in accordance with PPR §24-8 (1) (b). The contracting authority can reject tenders that include deviations from the procurement documents, uncertainties etc., which must not be considered insignificant, cf. the Public Procurement Regulations §24-8 (2) (a). Tenderers are therefore strongly encouraged to follow the instructions given in this tender documentation with annexes and possibly to question uncertainties through EU Supply to the contracting authority's gender neutral preferred.

Tenderers must not have significant tax and VAT arrears, or an approved repayment plan shall be in existence.: Documentation requirement: - Tax certificate, not older than six months.
Tenderers must have sufficient economic and financial capacity to fulfil the contract. Tenderers must achieve a minimum rating of "credit worthy", i.e. tenderers must be in risk class 5 or higher on Experians scale.: Documentation requirement: Norwegian tenderers: As documentation, the contracting authority will obtain the credit rating Commercial Delphi Score from Experian. Tenderers must achieve a minimum rating of "Credit worthy", i.e. risk class five or higher on the Experians scale. Foreign tenderers: As documentation, tenderers can submit a credit rating from a credit rating company with a licence to operate a credit information company. The credit rating shall show the current financial situation of the company and be based on the last available accounting figures. For all tenderers: If there is a justifiable reason not to provide a credit rating, the tenderer can submit any other document demonstrating that the economic and financial capacity requirements are met. However, the documentation must be approved by the contracting authority. If a tenderer has a credit rating in Experian and the contracting authority obtains it, it will always have a rank before credit rating, or other documentation obtained by the tenderer.

Tenderers shall have experience from comparable contracts. Comparable assignments means the delivery of temporary staff within educational personnel in accordance with the requirement specification.: Documentation requirement: Description of up to 3 of the tenderer's most relevant contracts in the course of the last 3 years. The description must include a statement of the contract ́s value, date and recipient (name, telephone number and e-mail address). It is the tenderer ́s responsibility to document relevance through the description.
