The aim of the procurement is to establish a contract that allows businesses to more easily buy used furniture, so that second hand purchases become a more accessible alternative to new furniture, where practical.
The competition is for the delivery of used furniture (Office, conference, school, canteen and lounge furniture).
Call-offs shall only be made on used furniture. Used furniture means furniture that has had at least one previous owner. So-called "B furniture" or furniture that comes directly from production shall not be offered in this agreement.

Based on the exception provisions in the Public Procurement Regulations § 7-9, fourth paragraph, we consider that the terms to utilise exceptions in § 7-9, 4th paragraph are fulfilled for the procurement of a framework agreement for used furniture, Akershus, Buskerud and Østfold Counties.
Grounds:
The competition requires that only call-offs shall be made on used furniture. Used furniture is defined with the following text: "Used furniture means furniture that has had at least one previous owner, and so-called "B furniture" or furniture that comes directly from production shall not be offered under this agreement».
Furthermore, there is also a guarantee requirement that is somewhat milder than that of new furniture, in combination with requirements for quality, durability and strength. This will ensure that the used furniture that is purchased does not have a lifetime and quality that is so poor that they must quickly be replaced.
By purchasing used furniture of high quality, the contracting authority contributes to extending the lifetime of already produced furniture, instead of stimulating extraction of new raw materials and new production. In this way, the Contracting Authority contributes to reducing the greatest environmental impact connected to procurements of furniture.
By requiring that used furniture of high quality is only offered, the contracting authority achieves a higher climate and environmental effect than will be ensured by using the award criteria. This is because through award criteria one only increases the likelihood of, but cannot guarantee, to end up with the purchase of used furniture, as price can trump the environment criteria.
The contracting authority therefore believes that it is clear that setting minimum requirements here gives a better climate and environmental effect than weighting climate and environmental considerations in the competition.
