Based on the exclusionary provision in the Public Procurement Regulations § 7-9, fourth section, we consider that the terms to utilise exceptions in § 7-9, 4th paragraph are fulfilled for the procurement of a framework agreement for the procurement, leasing and vehicle administration of vehicles Akershus, Buskerud and Østfold Counties. Grounds: Market surveys have shown that it is possible to set requirements for 100% zero emission vehicles in several of the vehicle groups in the competition. Akershus, Buskerud and Østfold County are subject to the regulations on emission requirements for vehicles for public procurements for road transport (zero emission regulations), and the main emphasis on the estimated number of procurements is zero emission vehicles. There are minimum requirements for fossil free vehicles in all vehicle groups where the market delivers zero emission vehicles. The competition requires that 3 out of six vehicle groups shall be zero emission material. Fossil fuel is required for the vehicle groups 2, 3 and 5. For these three vehicle groups, the requirement for equipment for the vehicles means that the current range of zero emission material does not deliver enough energy. This is reflected in completed market surveys. These vehicle groups require, for example, 4X4 and a lot of assembled equipment such as fixtures, warning lights, work lights, friction meters, inverters etc. The requirements mean that we have a higher energy need in the cars than an electric car can deliver. This applies to the transport departments in the counties. If the share of zero emission vehicles is used as the award criterion, there is no guarantee for the proportion of zero-emission vehicles that we are offered, nor is there a guarantee that the tenderer actually delivers this during the contract period. Where this is instead set as a minimum requirement, only the tender offers satisfy the requirements that are evaluated in the competition. In this competition, where the market shows that the market can largely deliver 100% zero emission vehicles, the minimum requirement on this will give a clearly better climate and environmental effect than if the share of zero emission vehicles was the subject of competition. The contracting authority has not found other suitable award criteria that will give a better environmental or climate effect than the minimum requirements in this competition.
