Compulsory occupational pension: Mandatory occupational pension scheme requirement
The tenderer is responsible for ensuring that their own employees, sub-contractors employees (including hired) who directly contribute to the fulfilment of the contract, have a compulsory occupational pension (OTP) in accordance with the Law on compulsory occupational pensions.
All contracts entered into by the tenderers involving the execution of work under this contract shall contain equivalent provisions.
Tenderers are obliged, upon written enquiry, with a reasonable deadline to document that all workers who contribute to the fulfilment of the contract and who come under a compulsory occupational pension scheme are registered in such a scheme. The documentation can include a copy of a signed contract with a pension scheme that shows that the tenderer and/or sub-suppliers have entered into a valid agreement on the OTP scheme as well as documentation, for example in the form of invoices etc., which shows that employees who directly contribute to fulfilling the contract are registered in the OTP scheme.
If there is a breach of the documentation obligation, the contracting authority has the right to impose a day fine that shall not be less than NOK 1500 per day.
If there is a breach of the requirement for compulsory occupational pension, the tenderer shall correct the situation.
The contracting authority has the right to retain an amount equivalent to approx. twice the savings for the tenderer. The retention right ceases as soon as the a correction in accordance with previous paragraph is documented.
Significant breaches of the requirement for compulsory occupational pension, including the documentation obligation, can be pleaded by the contracting authority as a basis for cancellation, even if the tenderer corrects the conditions. If the breached occurred in the sub-supplier chain (including manpower companies), the contracting authority can demand that the tenderer replaces the sub-supplier. This shall be carried out at no cost to the contracting authority.
