Exception to climate and environmental considerations, cf. the Public Procurement Regulations § 7-9 (4):
Cleaning services consume large amounts of energy, water and chemicals each year. By making requirements in the requirement specification that the cleaning service is Swan Ecolabeled or marked with equivalent marking schemes, the contracting authority will ensure that central climate and environmental considerations in the service are safeguarded, including contributing the contracting authority to several of the UN's sustainability goals and circular economy.
These marking schemes have many underlying requirements that include the entire operation of a cleaning business, for example:
*Environmental and health requirements for chemicals used.
*Reduction in the amount of chemicals used
*Requirements for efficient transport.
*Requirements regarding waste quantities and waste management
Other types of requirements and award criteria to environments that are commonly set in public procurements for cleaning services, will only be able to document that a few of these requirements are fulfilled and will therefore not have an equally high climate and environmental effect.
Cleaning services will therefore ensure better climate and environmental effect by setting requirements for type 1 environmental labels in the requirement specifications than by the use of award criteria, provided that the market is mature and can comply with the requirement. This is because, with a minimum of 30 percent weighting of environmental labelling type 1, the price could be decisive in the competition, and thus it will end up without an environmentally labelled cleaning service.
The contracting authority assesses, on the basis of the above, that the exclusion provision in the procurement regulations § 7-9 fourth paragraph, the first period will apply:
"Award criteria in accordance with the second and third paragraphs can be replaced or combined with climate and environmental requirements in the requirement specification, if it is clear that this gives a better climate and environmental effect and this is justified in the procurement documents."

This rejection reason also includes incitement to, participation or attempts to commit such actions as included in Article 4 in the mentioned framework decision.
