Hovedtrekk ved prosedyren:
The framework agreement shall cover the contracting authority ́s need for statutory annual inspections and service during the agreement period. The framework agreement shall also cover the contracting authority ́s need for ongoing maintenance and repairs, as well as the procurement of relevant products in the contract period. Other services that naturally come under the disciplines included in the framework agreement can be provided if there is a need in the contract period. The contracting authority reserves the right to make minor individual supplementary procurements outside of the framework agreement. The contracting authority reserves the right to bypass the framework agreement in cases where the chosen tenderer cannot deliver within the agreed deadlines, regardless of the scope of the procurement. This framework agreement gives the contracting authority the right, but not an obligation, to award contracts within the framework agreement. The Contracting Authority is not obliged to procure any specific amount of services and goods in the framework agreement period. Øygarden municipality can carry out repairs and replacements of a major nature if the municipality deemed it appropriate. The contracting authority can choose to procure large building or renovation projects that are included in the framework agreement through executing contractors if appropriate. The contracting authority shall only be obliged to procure materials through the tenderer in connection with assignments specifically awarded to the tenderer. The service contract during the guarantee period will as a main rule accrue to executing contractors. See Annex 4a Price Form for an overview of facilities at Øygarden municipality ́s locations. Emphasis is put on the fact that the overview of the facilities in Annex 4a Price Form is not exhaustive and that the overview may change during the contract period due to adjustments to the municipality's properties. The framework agreement shall also include any new installations that are procured and/or built by the municipality in the contract period. Furthermore, facilities should be able to be pulled out of the scope of the agreement in cases where the municipality disposes or winds down the use of the building. New installations that are under guarantee and have the current contract for inspections during the guarantee period, will only be part of the scope of the agreement when the warranty period has expired. New installations that do not have a current contract for inspections during the guarantee period, shall be phased in the contract without undue delay.

Tenderers shall have sufficient economic and financial capacity to fulfil the contract. The required financial capacity will be assessed in relation to the contract ́s value, services, risk and duration. Creditworthiness with no requirement for collateral will be sufficient to meet the requirement. Documentation requirement: Credit rating based on the most recent financial figures. The rating shall be carried out by a credit rating company that is in accordance with the legislation in the Credit Information Act. If a tenderer has a justifiable reason for not submitting the documentation required by the contracting authority, he can document his economic and financial capacity by presenting any other document that the contracting authority deems suitable, e.g. the last year's approved annual accounts with the board's annual report and auditor's statement. Recently established companies that cannot present approved annual accounts can submit the accounts that have been completed.

Tenderers shall have established procedures that ensure that the execution of the delivery has a low environmental impact. Documentation requirement: A description of the tenderer's environmental management measures. If a tenderer is certified in accordance with ISO 14001, EMAS or Miljøfyrtårn or equivalent, it is sufficient to enclose a copy of a valid certificate provided that the environmental management measures are covered by the certification scheme.
HSE quality assurance requirements.: Qualification requirement: Tenderers shall have a suitable board system for health, safety and the environment (HSE). Documentation requirement: A description of the tenderer's board system for health, safety and the environment (HSE), including how the safety of persons, material and surrounding infrastructure is safeguarded in an equivalent manner as well as how registered events are followed up. Please note that the HSE self-declaration is not sufficient documentation to prove that the requirement is met. If a tenderer is certified in accordance with ISO 45001:2018 or equivalent, it is sufficient to enclose a copy of a valid certificate.

Tenderers shall be a legally registered company.
Documentation: Documentation: Documentation must not be enclosed for tenderers registered in the Norwegian Register of Units. The contracting authority will check the registration by using the organisation number stated in the tenderer ́s Mercell profile.
Tenderers who are not registered in the above register must present a certificate or confirmation (equivalent company registration certificate) for registration in a trade or business register as prescribed by the law of the country where the tenderer is established. Such a certificate shall not be issued more than six months before the tender deadline.

The contracting authority can require up to three years experience and allow experience from before the previous three years to be taken into consideration.

Tenderers shall have good and relevant experience. The experience shall include deliveries of equivalent complexity as the delivery requested in this competition.
Documentation requirement:
Relevant experience shall be documented by stating a minimum of three (3) and a maximum of five (5) reference projects from the last three (3) years. The overview shall include information on the contracting authority, contact information of a reference person at the contracting authority, the value of the assignment, date of execution of assignment and description of the scope and content of the assignment. It is the tenderer ́s responsibility to document relevance through the overview. Øygarden municipality reserves the right to contact the contracting authorities for the reference assignments. The references are to be added directly to Mercell as a response to this point. If more than five reference projects are given, only the first five will be assessed.
