This competition concerns agreements on a duty to deliver newspapers subscriptions to subscribers who do not have other newspaper distributions, in accordance with the Postal Services Act of 4 September 2015 no. 91 (the "Postal Act") § 6 and 7 second sections, cf. the regulations on post by 18 September 2015 no. 1063 ("The Postal Regulations") § 19. The service is characterised as a service of general economic importance. The procurement is expected to be carried out in accordance with the EEA agreement ́s rules on public support and the so-called Altmark criteria. The Ministry of Transport ("the Contracting Authority") shall procure postal services in the form of newspaper distribution on Saturdays and three scheduled weekdays (Tuesdays, Thursdays and Fridays) in counter-cyclical distribution to ordinary postal deliveries. Counter-cyclical distribution involves the delivery of subscription newspapers on only the weekdays that the individual address does not have post deliveries. Such services shall be provided in the geographical area stated in the Requirement Specifications in Annex 1.3, 2.3, 3.3 and 4.3 - Point 3 ("The Geographical Area"). The geographical area is divided into two delivery areas, delivery area B and delivery area C. Tenderers can submit tender offers on agreements for distribution on Saturdays and/or tenders for contracts for distribution in the days of the week. Tenders can be submitted for both Saturday distribution and weekday distribution, but there must be separate tenders. Separate tenders shall also be submitted for each delivery area. One contract will be signed for the distribution of newspapers per delivery area for weekday distribution and Saturday distribution respectively. The contracting authority will thus enter into four total agreements. Contract terms that shall apply to the four contracts are in the attached agreements, cf. annex 1.0 (Saturday distribution north), annex 2.0 (Saturday distribution south), annex 3.0 (weekday distribution north) and annex 4.0 (weekday distribution south). When the contracts are signed, in each individual contract, it will be specified which part of the Geographical Area the contract applies to in a separate Annex 1 belonging to each contract. The contracts will be signed for one year, with an option for the contracting authority to extend the contract for a further one year. The estimated value for each of the contracts is estimated to be between NOK 100,000,000 excluding VAT, to NOK 100,000,000 excluding VAT. NOK 150,000,000 excluding VAT for the entire contract period, including the option year. The estimated total value for the 4 contracts included in this procurement is from NOK 400,000,000 excluding VAT to NOK 600,000,000 excluding VAT for the entire contract period including the option year. The estimated value is not binding for the contracting authority.

Economic and financial capacity: Requirements: Tenderers must have sufficient economic and financial capacity to be able to fulfil the contractual obligations. Documentation: Tenderers shall enclose annual accounts for 2020, 2021 and 2022, including the board ́s annual report and the auditor ́s statement. Tenderers who may be newly established and therefore do not have annual accounts for all the last three years, can document their financial implementation ability with any other document that the Contracting Authority deems suitable. Sufficient economic and financial capacity will particularly concern the tenderer's annual turnover as regards the contract value. Requirements: Tenderers shall have sufficient solidity to fulfil the contractual obligations. Documentation: A credit rating with key figures from a certified credit rating company that gives the tenderer a rating equivalent to A - credit worthy. The credit rating shall not be older than three months at the tender deadline and it shall be based on the last accounting figures. If a tenderer has justifiable reasons for not presenting a credit rating (e.g. newly established companies), the tenderer can prove his economic and financial position with another document that the contracting authority deems suitable. The credit rating shall include the credit rating degree (rating) of the tenderer - typically indicated by a rating code or brief text. The assessment shall include or be attached with an explanation on the rating code/scale of possible rating codes.

Paid taxes and duties: Requirements and documentation: Norwegian tenderers: Tax certificate, not older than six months calculated from the tender deadline, which confirms that the tenderer has fulfilled his obligations with respect to the payment of taxes, social security contribution skatteetaten.no s and VAT. If this is not possible, it can be ordered from the tax collector or the Norwegian Tax Administration. The certificate is electronically certified and is therefore not signed. See the skatteetaten.no for further information. Foreign tenderers: Equivalent documentation from a competent authority confirming that the tenderer has fulfilled his obligations in the country where the tenderer is registered as a company. The certificate shall not be older than six months from the tender deadline. The certificate must also be presented for sub-suppliers that the tenderer will use to fulfil the qualification requirements in points 3.1.3 and 3.1.4. Foreign tenderers:

Technical and professional qualifications: Requirements: Tenderers shall have sufficient experience to fulfil the contract. Documentation: A description of the tenderer's up to three most relevant assignments in the last three years. The description must also include information on the contract ́s value, date of delivery or execution and the name of the recipient (if possible). Relevant assignments means distribution of mailings to private and/or business addresses of a comparable extent as in this contract. Tenderers are themselves responsible for ensuring that the description is of such a nature that it documents that the requirement is met. Tenderers shall state reference persons and their contact details. The Ministry reserves the right to contact the tenderer's reference persons. Requirements: Tenderers shall have sufficient experience to fulfil the contract. Tenderers shall have a quality assurance system that is adapted to the assignment ́s complexity, risk and aims, and is suitable to demonstrate the tenderer ́s ability to minimise deviations in the execution of the contract. Documentation: Tenderers shall give a description of the tenderer ́s quality assurance methods (quality assurance system) and state the date for implementation of such a system. Tenderers shall confirm that the quality assurance system will be in operation at the time of the contracts' commencement. Tenderers shall give an account of how the quality system ensures good delivery routines, including route planning. Routines shall also be described for deviations such as missing bids, error delivery, delays and complaints related to execution of the assignment. Certain quality assurance standards are not required, for example ISO 9001 or equivalent quality assurance certifications, but this can be used as documentation to fulfil the requirement.
