The main purpose of the procurement is to ensure the annual operation of biologically valuable meadow environments in Oslo, so that the natural qualities of the meadows are maintained and improved, and to restore biologically valuable flower meadows that have deteriorated. These are mainly flower meadows managed by the Agency for Urban Environment [Bymiljøetaten], which have been operated for years under the individual park contracts.
The procurement is divided into three lots, including; Oslo south, Oslo west and Oslo centre and the outer city. Tenderers can submit tender offers for all of the lots, but only one lot per supplier will be awarded.

Requirement: Tenderers must be a legally established company.
Documentation: Norwegian companies: Certificate of Business Registration
Foreign tenderers: Verification that the company is registered in a trade index or a register of business enterprises as prescribed by the law of the country where the company is established.
Økonomisk og finansiell stilling:
Requirement: Tenderers must have sufficient economic and financial capacity to carry out the assignment and tenderers must be credit worthy.
Documentation: The company's Annual Financial Statements for 2021, 2020 and 2019 including notes, the Board's Annual Report and the Auditor's Report, as well as newer information of relevance to the company's fiscal numbers and credit rating.
The contracting authority reserves the right to obtain credit assessments.
If a tenderer has valid reasons for not being able to provide the documentation requested by the contracting authority, the tenderer can prove his economic and financial position with any other document that the contracting authority deems suitable.
Teknisk og faglig kapasitet:
(1) Requirement: Tenderers must have sufficient experience of a relevant nature and scope. This means, among other things, experience with:
- Care of meadow environments
- Registration of foreign species
- Restoration of meadow environments
Relevant scope means experience from work as described in the requirements specification.
Documentation: An overview of contracts during the last 5 years where the tenderer has carried out work of a relevant nature and scope as described in the tender documentation. The summary must indicate the contracting authority, nature of the work, scope and value, as well as the time and location of execution of the work. See Annex 12.

If the requirement is fulfilled through a subcontractor, this will be used in the contract, and a declaration of commitment must be attached. Use the attached template for the commitment statement, see Annex 2.
(2) Requirement: Tenderers must have sufficient technical, personnel and organisational capacity to carry out assignments of an equivalent scope as that in this procurement. This means, among other things, that the tenderer should offer two supervisors who are either:

o Or who have equivalent green competence.
Supervisor means the resource person who will have overall responsibility for the coordination and execution of the contract works and who will otherwise ensure that the contract works are carried out in accordance with the description. The supervisor must be physically present during part of the execution of the contract works and be the Contracting Authority's contact person.

(3) Requirement: Tenderers must have a satisfactory quality assurance system that is appropriate for the contract work.
Documentation: A description of the tenderer's quality assurance measures.
Description of routines and methods for the execution, internal control and documentation of the work out in the field. A description and submission of actual parts of the tenderer´s quality system, with a statement of when it was last updated. If a tenderer is certified, a copy of a certificate issued by the certification body shall be submitted.

(4) Requirement: Environmental management measures must have been established which ensure that the tenderer is suitable to fulfil the contractual obligations for environmental regulations. This means that the tenderer must have established methods for working actively and systematically with reducing negative environmental impact from the tenderer activities related to the implementation of this contract.

If the tenderer has certificates from independent bodies documenting the environmental management system relevant to the contract work, these can be submitted as documentation. The contracting authority refers in this connection to the EMAS (Eco-Management and Audit Scheme), or other acknowledged environmental management systems stated in the decree (EF) no. 1221/2009 article 45, such as the Environmental Lighthouse Scheme or equivalent, and other environmental management standards that are based on relevant international standards from accredited bodies, e.g., ISO 14001 or equivalent.

The contracts cover the areas of Oslo south (lot 1), Oslo west (lot 2) and Oslo centre and the outer city (lot 3). One lot will be entered for each area. Tenderers can submit tender offers for all three lots, but can only be awarded one lot.
The tenders will be evaluated in the following order: lot 1, lot 2 and lot 3. Tenderers who are awarded a lot will not be involved in the evaluation of other lots.
Notification of the award of the lots will be made simultaneously. It should be noted that any reversal of the outcome of the contest for one lot will potentially have an impact on other lots. This will be relevant where the same tenderer has submitted tenders for several lots.

Cancellation of lot 3
The legal basis for cancellation is paragraph 25-4 of the Public Procurement Regulations, which states that the contracting authority may cancel the competition with immediate effect if there are objective grounds. In this contest, three tenders were received for lot 3. Two of these tenderers were excluded from the evaluation due to the award of lots 1 and 2, see point 2.5 of the tender documentation. As only one tender remains, we have decided to cancel the contest for lot 3. An additional argument for the existence of a justifiable reason for cancellation is that the Contracting Authority is left with the most expensive of the three tenders submitted in the contest, cf. KOFA- case 2019/329
