1.6.1 Tax certificate
Qualification Requirement:
Tenderers must have the tax and duty payments in order.
Documentation requirement:
Tax certificate, not older than 6 months, calculated from the tender deadline.
1.6.2 Registration, authorisations, etc.
The tenderer must be a legally established company and must be registered in a company register or trade register in the member state where the tenderer is established.
Norwegian tenderers: Company registration certificate
Foreign tenderers: Verification that the tenderer is registered in a company register, professional register or a trade register in the country where the tenderer is established.
1.6.3 Economic and financial capacity
Qualification Requirement:
Tenderers must have sufficient economic and financial capacity to fulfil the contract.
Tenderers must have minimum Bisnode rating A or equivalent.
Documentation requirement:
A printout of a credit rating showing the financial ranking must be attached to the tender.
The printout can be downloaded from Bisnode, Experian or equivalent credit rating agency. The credit rating must not be older than 3 months.

1.6.4 Technical and professional qualifications
Qualification Requirement:
Tenderers must have experience from equivalent assignments.
"Similar assignments" means interior architecture assignments.
The tenderer cannot rely on other businesses to fulfil this qualification requirement.
Documentation requirement:
An overview of the most important interior architecture assignments that the tenderer has carried out in the last three years.
The overview shall indicate:
- The name of the service (framework agreement)
- The name of the recipient (contracting authority)
- The date of the delivery or execution
- The contract value
1.6.5 Technical and professional qualifications
Tenderers are required to have a well-functioning quality assurance system
Documented by a description of the tenderer’s quality assurance system.
Tenderers are required to have a well-functioning environmental management system.
A description of the tenderer's environmental management measures.

Justification for cancellation
When evaluating the tenders the contracting authority concluded that the award criterium 'quality' (weighted 40%) is contrary to the public procurement regulations § 18-1, and is, therefore, illegal. Furthermore, the chosen distribution key for call-offs has been illegally formulated and is contrary to the public procurement regulations § 26-3 (1). According to the public procurement regulations, the distribution key must reflect the result in the contest, cf. Dragsten (2020), comments to § 26-3 point 2.
The contracting authority has, thus, a duty to cancel the contest and a cancellation right.
The contracting authority's obligation to cancel a contest was developed through committee and legal practice. Three terms must be fulfilled for there to be an obligation to cancel;
(1) An error has been made in the tender documentation or in the implementation of the contest
(2) The error can have influence participant interest or the outcome of the contest
(3) The error can only be rectified by cancelling the contest
As mentioned in the previous section, there are several errors in the contest. Both of these errors will have influenced the outcome of the contest. The contracting authority is not able to correct these errors without cancelling the contest. In order to correct the errors that have been made, significant changes are required to the contest documents and the award criteria.
The contracting authority therefore has a duty to cancel the tender contest.
Pursuant to PPR § 25-4 (1), the contracting authority can cancel a contest if there are reasonable grounds:
§ 25-4 cancellation of a contest.
(1) The contracting authority can cancel a contest with immediate effect if there is a justifiable reason.
(2) The contracting authority will provide the tenderers with a written notice of cancellation as soon as possible. The notice will contain a brief reason and any information about the implementation of a new competition concerning the same procurement.
Based on the errors made in the contest documents, the contracting authority also has 'reasonable grounds' to cancel the contest.
There is both a duty and a right to cancel.
We will announce the contest again. A new notice is scheduled for week 3 or 4.
