The objective of the agreement is to cover the contracting authority's need for workwear, accessories and footwear for employees working in nurseries, 1st. grades and wraparound care services, 2022. It must also be possible for other entities in the contracting authority's organisation to enter into the agreement if required.
The main assortment in this agreement consists of thermal suits, all-weather clothing, rainwear, boots, hiking shoes, gloves and mittens. The products listed in the main assortment are given and are further specified in the price and product sheet. It is important for the contracting authority that the products in the main assortment are to the most possible extent: of good quality, suitable and functional for the intended area of use, comfortable to wear and move in, user-friendly, of good design and fit / shape.
The contracting authority will need to procure other types or other models than listed in the main assortment, and discounts shall therefore be offered on other assortments within the categories, workwear, accessories and footwear in the price and product sheet.

The upper limit of the agreement is set at NOK 3 million excluding VAT.

Payment of taxes, VAT, and other public duties:
Norwegian tenderers: After tender submission, the tenderer must give consent for TendSign to obtain and for the contracting authority to receive information about the above via Tendsign. After tenderers have submitted their tender in TendSign, they will receive a request from Altinn for consent to share the tax information. The consent is valid on an organisation level and is valid for 3 (three) months. If a tenderer does not give consent, the tenderer must attach a tax and VAT certificate. The certificate must not be older than 6 (six) months from the tender deadline. Any arrears or other irregularities must be justified. (Tenderers can obtain the electronic tax and VAT certificate themselves and immediately receive it by email.) Foreign tenderers: Tenderers who are not established in Norway can present equivalent documentation issued by the authorities in the country where the tenderer is established. The certificate shall preferably be translated into Norwegian, but it will also be accepted in Swedish, Danish and English.

Credit Rating:
The contracting authority will carry out an assessment of the tenderer´s finances through the company and accounting information system Bisnode AS (www.soliditet.no/creditcontrol) with the service CreditPro. The contracting authority is not accepting credit ratings from other company and accounting information systems than Bisnode AS with the service CreditPro so that the Tenderers can be assessed on equal terms. Tenderers can attach other necessary information with their tender if the tenderer is of the opinion that Bisnode/CreditPro will not provide an accurate picture of the financial situation. Newly established companies: Newly established companies who have not worked up a basis for a credit assessment must enclose a declaration from a bank or similar financial institution on the company´s financial and economic standing. This also applies to foreign tenderers.

Tenderers must have their tax, payroll tax and VAT payments in order in accordance with the legal provisions, and tenderers must not have significant arrears.
Credit Rating:
The financial capacity to carry out the agreement is required. A minimum requirement is that the tenderer is credit-worthy with a score of A in accordance with Bisnode AS using the service CreditPro, or that the tenderer has the financial capacity to implement the agreement, based on the contracting authority’s assessment in accordance with the attached documentation from tenderers. Newly established companies must have the financial capacity to fulfil the contract.

Justification for cancellation
Pursuant to PPR § 25-4 (1), the Contracting Authority can cancel the tender contest with immediate effect if there are justifiable reasons.
The contracting authority has rejected all the tenders in the tender contest. The grounds for rejection are deviations from the procurement documents, cf. the PPR §24-8 (1) b and §24-8 (2) a.
The contracting authority has assessed that there is a justifiable basis to cancel the contest with immediate effect. The tender contest is cancelled due to a lack of competition, cf. the Public Procurement Regulations, § 25-4 (1).
The contracting authority will implement a new tender competition with negotiations without a prior information notice, cf. the Public Procurement Regulations § 13-3 b.
