Procurement of a framework agreement for operational leasing of tablets

Lørenskog kommune

Lørenskog Municipality currently has a contract for operational leasing of tablets for the education sector. The municipality has approx. 5000 pupils in primary and secondary schools who have their own tablets, as well as employees in nurseries and schools with their own tablets in addition. It is important for Lørenskog to ensure continuity in schools and maintain continual access to tablets, and the aim of the new contract is to ensure efficient access to tablets for use particularly in educational situations, but also for the rest of the municipality if required. Lørenskog Municipality would like to use operational leasing to ensure predictability. The starting point for the procurement is to continue use of iOS based tablets 1:1 for all pupils and teachers in primary and secondary schools. Tablets are the pupils' main everyday day. iOS based tablets will be procured to ensure continuity and use of investments connected to software for the platform. This comes under the exception in the PPR section 15-1 (4) letter a), 'necessary for the purpose of the procurement'.

Lørenskog Municipality would like to enter into a framework agreement (SSA-R with annexes) that includes leasing and the delivery of equipment. The framework agreement will also include covers, keyboards, chargers, and any other necessary additional equipment for tablets, as well as an option for consultancy services for assistance with the operation and management of the municipality's MDM system Intune.

The procurement will primarily cover the contracting authority's need for access to tablets for use in teaching, with an option for leasing to the entire municipality. Leasing tablets is seen as most appropriate for the municipality. There are approx. 7500 pupils and employees in the municipality with tablets as the primary tool.

Beskrivelse av opsjoner:
The contract period will be 2 years, with options for 1 year + 1 year. The options will be renewed automatically, unless the contracting authority gives written notification that the option will not be taken up 3 months before the start-up of the option. In the contract period the contracting authority will have 6 months notice. The total contract period can be 4 years. It is important for the contracting authority that there is continuity in teaching and therefore a framework agreement must be used for the same type of iOS tablets in teaching.

Egnethet til å utøve yrkesvirksomheten:
Requirement: Tenderers must be registered in a company register, professional register or a trade register in the country where the tenderer is established.
Documentation: Norwegian companies: Certificate of Business Registration
Foreign companies: Verification that the tenderer is registered in a company register, professional register or a commerce register in the country where the tenderer is established.
Økonomisk og finansiell stilling:
Requirement: Tenderers must have adequate economic and financial capacity to comply with the contractual obligations. As a minimum, tenderers must fulfil the following requirements:
Annual turnover of minimum NOK 20 million in 2021.
Documentation:
The entity's annual financial statements or extracts thereof if the publication of the annual financial statement is required in the country where the tenderer is established.
If a tenderer's accounts are not publicly available, the annual report for the last 3 years must be submitted, including the auditor's report.
If a tenderer cannot provide the above mentioned documentation, or wants to document that this gives a misleading picture of his financial situation, he must prove his economic and financial position by providing other documents relevant to the company's accounting figures/finances. Tenderers must then provide specific reasons why the requested documentation may not be available or gives a misleading picture.

Teknisk og faglig kapasitet:
Requirement: Tenderers must document experience from comparable assignments with operational leasing of tablets to customers of a comparable size as Lørenskog Municipality.
Documentation: List of the most important and most relevant deliveries in the last three years. The description must include information on the assignment's value, date and recipient. The documentation requirements are connected to leasing tablets, not procurements.

Kontraktutførelse
Vilkår for kontraktoppfyllelse:
The procurement will be regulated by the contract provisions in the attached contract terms, cf. SSA-E and annexes.
A binding contract will not be deemed as entered into before it has been signed by both parties.
Sub-suppliers are allowed, the main rule is that only one link in the chain will be accepted under the main supplier. Two links can occasionally be accepted with a justification.
