The contracting authority makes reservation to the project being approved by other public authorities as well as political approval of the project by the municipal council.

The contract shall be carried out in accordance with the Public Procurement Act (Norwegian: LOA) LOV-2016-06-17-73 and the Public Procurement Regulations (Norwegian: FOA) FOR 2016-08-12-974, part I and part III. The award of contract will be made in accordance with the negotiated procedure after a prior notice, cf. §13-1(2) og § 13-2 c.

The tender contest is initiated with a qualification phase. All interested tenderers can send in a request for participation in the contest. Only tenderers who fulfil the qualification requirements and who have been invited, will be able to submit a tender.

The contracting authority will select several participants which are sufficient to ensure a real tender contest, but still not less than three if there are enough qualified suppliers available. The selection of participants to the tender contest will be based on the selection criteria in point 8.

All invited tenderers will have their tenders evaluated.

The negotiations can apply to all parts of the tenders. The negotiations can be carried out in several phases, preferably in writing, but also orally. The contracting authority reserves the right to reduce the number of tenders after each phase based on the award criteria. The contracting authority will conclude the negotiations by setting a joint deadline for the receipt of the final tenders from the remaining tenderers.

After the negotiations, the final tenders are evaluated, and the contract awarded. Negotiations are not allowed in the final tendering procedure.

Attention is drawn to the fact that tenders that include significant deviations from the procurement documents shall be rejected in accordance with the Public Procurement Regulations § 24-8, (1), b. Such a rejection will exclude any negotiations on their tender.

Tenderers are therefore strongly encouraged to follow the instructions given in this tender documentation with attachments and ask questions in case of ambiguities via the communication module in the Mercell portal.

The contracting authority reserves the right to award the contract without negotiating, c.f. the Public Procurement Regulations § 23-7 (5).

Norwegian tenderers must have their affairs in order regarding the payment of tax, employer contribution and value added tax (VAT). Tax Certificate not more than 6 months old.

Tenderers must be registered in a company register, professional register or a trade register in the country where the tenderer is established. Norwegian companies: Company registration certificate

Foreign companies: Verification showing that the tenderer is registered in a company register, professional register or a commerce register in the country where the tenderer is established.

Tenderers must have sufficient economic and financial capacity to comply with the contract. Creditworthiness with no requirement for guarantees will be sufficient to meet the requirement. Credit rating based on the most recent accounting figures. The rating must be carried out by a credit rating agency with a licence to provide such service.

Teknisk og faglig kapasitet:

The supplier/contractor must have experience from relevant assignments.

Relevant assignments are defined as buildings of an equivalent size and complexity as well as partnering as an implementation model.

To meet the requirement, the turnkey contractor must during the last seven years.

Description of the tenderer's three most relevant contracts in the last seven years.

The tenderer must join up with an architect who has valuable experience from equivalent relevant assignments and experience from interaction contracts/partnering.

Tenderers can document experience by referring to the competence of the personnel that can be used for this assignment, even if the experience was acquired whilst the personnel was in the service of another employer.
