The technology, energy concept, and energy store requirements are described in chapter 5 of the contract. If the winning tender uses less fuel on the Nordhordland route each year than what is stated in the contract's climate requirements, the winning tenderer will receive a climate bonus.

For further information on the requirements for fulfilling the contract, see the contract document for delivery requirements in chapter 2, requirements for vessels in chapter 3, requirements for route production in chapter 4 and climate requirements in chapter 5.

The contracting authority would like to enter into a joint contract for the operation of the two routes with one operator.
The contract period is from the date the contract is signed until and including 15 January 2040. The start-up of operation must be latest 20 January 2025, with an option for the winning operator to start up earlier. See the contract point 1.1.6.1.
Skyss estimates an annual contract sum of approx. NOK 68 million to NOK 73 million deducted support and estimated one-time costs connected to energy infrastructure, grid upgrade and quay improvements of NOK 47 million to NOK 51 million. This is equivalent to NOK 70 million to NOK 80 million a year if the costs of the energy infrastructure, quay improvements, and grid upgrade are spread out over the years, and after the deduction of support from the NOx fund and Klimasats. These estimates do not include the contract's rights to change and options, partly the operator's right to start operations earlier, the contracting authority's right to increase the route production, access to require larger and/or extra vessels on the routes, change rights.

Beskrivelse av opsjoner:
The winning operator will have the right to start up operation of one or both routes earlier than 20.01.2025 in the period 1 July 2024 to 20 January 2025. If the contracting authority, through a dialogue with the Grid operator before the final tender deadline, receives information that says that the grid upgrade will be completed at an earlier date, the option period will be further expanded.

The boat route Kleppestø - Strandkaien uses quays in Askøy Municipality and Bergen Municipality. The boat route route Knarvik - Frekhaug - Strandkaien uses quays in Alver Municipality and Bergen Municipality.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
Tenderers must have their tax, payroll tax and VAT payments in order. Tenderers must be a legally established company.
Tenderers must have good competence and experience from operation of express boats for passengers.
Økonomisk og finansiell stilling:
Tenderers must have sufficient economic and financial strength to be able to fulfil the contract.

Annual accounts
The tenderer’s annual accounts including notes with the boards and auditor's reports for 2019, 2020 and 2021. For the 2021 financial year, the contracting authority will accept auditor-approved accounts.
Demand guarantee
Confirmation from a bank, insurance company or financing institution must be attached stating that a demand guarantee for correct fulfilment of the Contract will be provided if the tenderer is awarded the contract.
The endorsement is confirmation that a guarantee in accordance with Annex G2 will be issued if the tenderer is awarded the contract. The declaration to provide a future guarantee must be binding for the guarantor throughout the entire period from the application deadline for qualification until the expiry of the abidance deadline for the tender in the contest. The contracting authority requests that tenderers use the template for the endorsement of a demand guarantee, Annex G1. The winning tenderer must send the final guarantee document to the contracting authority at the latest within one month after contract signing, cf. point 1.3 of the contract. Licence guarantee
Confirmation from a bank, insurance or financing institution shall be enclosed stating that a licence guarantee in accordance with the Professional Transport Act is presented if the tenderer is awarded the contract.
The endorsement is confirmation that a guarantee will be issued. Tenderers are requested to use the template for endorsement of a license guarantee, Annex E.

Liquidity plan
Tenderers must deliver a brief description/plan for how the tenderer will maintain or possibly improve the liquidity in the company in the coming years. For example.: What does the company do to ensure its liquidity? What is the desired liquidity degree in the company?

Credit Rating
The contracting authority reserves the right to carry out a credit rating with the help of an independent credit rating company. Financial strength will be evaluated in relation to turnover, operating profit margin, equity and liquidity.

Tenderers must have good competence and experience from operation of express boats for passengers.

Tenderers must document their experience in the last 3 years with
- Operation of minimum 1 express passenger vessel with a maximum length of 24 metres or longer, where
o the operation of the vessel was part of a publicly available route service with a public contracting authority for a minimum duration of 1 year and
o the operation had minimum 2 daily departures 3 days a week.
The reference assignments must as a minimum contain information about:
• Contracting authority
• Connection information
• Commencement and end dates
• Brief account of the assignment (frequency/scope, (number of departures per week) vessel size, crossing speed).
• Contract value and duration
Tenderers must complete and attach the form Annex D.

Justification for cancellation
During the prequalification we have found that the guarantee template and the associated pledge for a demand guarantee are unclear.
This is an error that can have influenced participation in the contest, and which can affect the outcome of the contest. The error cannot be corrected in any other way than by cancelling the contest, see, amongst other things, HR-2019-1801-A, section 85 and the EFTA law court's statement in case E-16/16, section 106.

Skyss therefore has a right and duty to cancel the contest, cf. the public procurement regulations, section 25-4. Skyss will announce a new contest as soon as possible for the operation of the ferry routes Kleppestø-Strandkaien and Knarvik-Frekhaug-Strandkaien.
