We aim to sign four to seven framework agreements with tenderers for legal services for the contracting authority.
Tenderers are to offer resources with very high expertise in finance regulations, including crisis management regulations for banks and the rules for winding-up banks under public administration, insolvency/bankruptcy law, asset management, transactions, administrative law, EU/EEA law, including competition law, government support rules, and public procurements.
Tenderers are to offer resources with very high expertise in finance regulations, including crisis management regulations for banks and the rules for winding-up banks under public administration, insolvency/bankruptcy law, asset management, transactions, administrative law, EU/EEA law, including competition law, government support rules, and public procurements.
Furthermore, good insight and competence is required in other relevant business legal and general law areas that affect the contracting authority's activities, including labour law, personal protection, contract law, etc., (see Annex 1).
The contracting authority has its own legal staff consisting of three persons who give advice and assist within the most central legal areas for the organisation. The procurement of external legal assistance will cover the need when the contracting authority does not have the capacity to provide the required legal assistance with internal resources, and/or when expertise is required within legal areas that are not covered internally, and/or are beyond what is covered internally. In addition to continual ordinary assistance, call-offs can be particularly relevant if liquidity and/or solidity situations arise in one of more banks, and the framework agreements will also be part of the contracting authority's preparedness set-up.

The scope will particularly depend on external circumstances and processes, particularly regarding liquidity and/or solidity situations in one or more banks. Note that the element of uncertainty regarding the occurrence of such external circumstances and the concrete scope of the assistance. However we consider it to be foreseeable that the scope of the assistance in a preparedness situation regarding liquidity and/or solidity situations in one or more banks can be considerable. This justifies the procurement's maximum value of up to NOK 25 million excluding VAT.
