We aim to sign four to seven framework agreements with tenderers for legal services for the contracting authority.
Tenderers are to offer resources with very high expertise in finance regulations, including crisis management regulations for banks and the rules for winding-up banks under public administration, insolvency/bankruptcy law, asset management, transactions, administrative law, EU/EEA law, including competition law, government support rules, and public procurements.

Furthermore, good insight and competence is required in other relevant business legal and general law areas that affect the contracting authority's activities, including labour law, personal protection, contract law, etc., (see Annex 1).
The contracting authority has its own legal staff consisting of three persons who give advice and assist within the most central legal areas for the organisation. The procurement of external legal assistance will cover the need when the contracting authority does not have the capacity to provide the required legal assistance with internal resources, and/or when expertise is required within legal areas that are not covered internally, and/or are beyond what is covered internally. In addition to continual ordinary assistance, call-offs can be particularly relevant if liquidity and/or solidity situations arise in one of more banks, and the framework agreements will also be part of the contracting authority's preparedness set-up.

Contract
The contractual relationship will be regulated by the attached contract (SSA-R) with the accompanying general contract text and annexes. The contract period is from the date it is signed for 2 years. The contracting authority has an option to extend the contract on the same terms for 1+1 year, so that the maximum possible contract length is 4 years.

Scope of the procurement
The estimated value of the contract is NOK 5 million excluding VAT.
The contracting authority is a preparedness organisation, and the scope of the requested legal services will depend on internal conditions and the work situation, as well as the scope of the concrete need for legal services. The scope will particularly depend on external circumstances and processes, particularly regarding liquidity and/or solidity situations in one or more banks. Note that the element of uncertainty regarding the occurrence of such external circumstances and the concrete scope of the assistance. However we consider it to be foreseeable that the scope of the assistance in a preparedness situation regarding liquidity and/or solidity situations in one or more banks can be considerable. This justifies the procurement's maximum value of up to NOK 25 million excluding VAT.

Tenderer A: Advokatfirmaet Schjødt AS; Tenderer B: Advokatfirmaet Selmer AS; Tenderer C: CMS Kluge Advokatfirma AS; Tenderer D: Advokatfirmaet Thommessen AS; Tenderer E: Advokatfirmaet Wiersholm AS. The award of contracts during the contract period depends of the estimated scope. If the estimated scope is less than one million NOK excluding VAT, or where the call-off concerns assistance in connection with a liquidity and solvency situation in one or more banks, the Contracting Authority must first contact Tenderer A directly, i.e. the tenderer that received the highest combined score overall in regards to the the award criteria in the competition. If this tenderer cannot deliver, the Contracting Authority will move on to Tenderer B, as this is the tenderer that received the next highest combined score overall in regards to the award criteria, and then to Tenderer C and so on, If the estimated scope exceeds one million NOK excluding VAT, except where call-offs for tenders concern assistance in connection with a liquidity and solvency situation in one or more banks, a mini-competition will be carried out.
