The contracting authority intends to enter into a framework agreement with a strategic collaboration partner with responsibility for carrying out modifications and maintenance of 4 Nansen-class vessels.
The framework agreement will help to strengthen the Defence's operational capabilities and preparedness through increased capacity for maintenance and upgrade services and relevant engineering support by providing the Defence with access to such services during times of peace, crisis, conflict and war.
In addition, the framework agreement will cover the Defence’s need to provide support to allied vessels in connection with exercises and crisis/war situations.

The scope mainly includes main routine (5-year classification), project and operation modifications, and extension of service life. The main routine, together with modifications, are jointly called main overhauling. The tenderer must take on general responsibility for the main overhauling. This includes management, planning, coordination, and facilitation of the scope that is executed by different sub-suppliers under existing framework agreements with the defence sector, as well as the deliveries carried out by the Norwegian Defence's own shipyards.

The framework agreement will be valid for 4 years with an option for an extension one or more times depending on the lifetime of the Nansen class and the need for maintenance and upgrade of them. The framework agreement can be extended up until the last vessel in the Nansen class has been phased out.

The tenderer must be registered in a company register, professional register or a trade register in the country where the tenderer is established. If the tenderer is a tenderer group, the requirement must be met by each individual participant in the group.

Confirmation that the tenderer is registered in a company register, professional register or a trade register in the country where the tenderer is established.

If the tenderer is a tenderer group, the above-mentioned documentation shall be supplied for each individual participant in the group.

Økonomisk og finansiell stilling:

Tenderers must have orderly conditions with regard to payment of tax, employer's national insurance contributions and VAT. This means that the tenderer should have no more than an insignificant amount of unpaid taxes and VAT, or should be able to provide a satisfactory explanation as to why they are arrears.

If the tenderer is a tenderer group, the requirement must be met by each individual participant in the group.

Documentation: Norwegian tenderers: Tax certificates (RF-1316) not older than 6 months from the application deadline. Tax certificates are defined as:

Certificate issued by the tax collector or the Norwegian Tax Authority for:

o VAT

o Tax

o Payroll tax

Foreign tenderers must provide documentation proving that the tenderer has complied with legal provisions regarding payment of taxes and duties in the state where the tenderer is established. If the tenderer is a tenderer group, the above-mentioned documentation shall be supplied for each individual participant in the group.

Tenderers must have sufficient economic and financial capacity to carry out the delivery, including minimum turnover, satisfactory profit ratio, liquidity ratio and equity ratio.

The tenderer must document a minimum revenue of MNOK 500 for each of the last 3 years.

If the tenderer is a tenderer group, the contracting authority will evaluate the fulfilment of the requirement for the tenderer group as a whole.

Tenderers shall provide the following documents:

1: The tenderer's Annual Financial Statements (including notes with the Board's and auditor's reports) from the last 3 years.for the tenderer and any parent company.

2. A credit assessment from a certified independent credit appraisal agency based on the most recent known accounting figures. The rating must not be older than 2 months.

3: An overview of any significant events that have occurred after the publication of the most recently revised Annual Financial Statements that will require adjustments (in cases where the financial statements have not been re-issued), or that are subject to reporting requirements in accordance with Norwegian and/or international accounting standards. If this documentation requirement is not relevant to the business or supporting business(s), it must be confirmed in writing upon request that the relationship is not relevant.

Tenderers must confirm that they are open to necessary access to information and permit the contracting authority to undertake necessary reviews/analysis of the tenderer's financial ability to fulfil the framework agreement.

If the tenderer has valid reasons for not being able to provide the documentation requested by the Contracting Authority, the tenderer can document their economic and financial capacity by presenting any other document that is relevant to the fiscal figures/economy of the company and that the Contracting Authority deems suitable. The tenderer must substantiate why they are unable to present the documentation required by the Contracting Authority. If the tenderer is a tenderer group, the above-mentioned documentation shall be supplied for each individual participant in the group.

Minste nivå(er) av standarder:

The tenderer must document a minimum revenue of MNOK 500 for each of the last 3 years.

Teknisk og faglig kapasitet:

(K4) The tenderer must have good experience from similar deliveries. Similar deliveries mean that the experience must apply to equivalent types of assignments, scope and complexity, including but not limited to ship and rig technical maintenance and upgrades, project and integration management, configuration management and coordination of one’s own works and that of sub-contractors.

The supplier must refer to experience from deliveries with an approximate scope of 300-400 days work in one or more shifts. If the tenderer is a tenderer group, the contracting authority will evaluate the fulfilment of the requirement for the tenderer group as a whole.

Documentation: Tenderers must attach an overview of the tenderer's 5 most relevant assignments in the last 5 years. The list must include an indication of:

Date

The contracting authority´s name

Contact person at the contracting authority (name, telephone number and email address).

Certificate from the receiver of the assignment(s), cf. FOSA Section 8-12 (1) c.

A short description of the delivery, including whether the supplier delivered on time, cost and performance

Relevance to this framework agreement.

It is the tenderer's responsibility to document relevance and complexity through the description. The description of each reference task should not exceed 3 A4 pages.

The contracting authority will only contact a given reference when selecting qualified Tenderers. The tenderer can attach appendix 9 of the Qualification documents - Optional certificate template as a certificate from the receiver of the assignment(s).

(K5) The tenderer must have sufficient man power to fulfil the delivery in the framework agreement.

The tenderer must command at minimum:

80 skilled electricians, of which a minimum of 30 must have Norwegian citizenship

80 skilled mechanics, of which a minimum of 20 must have Norwegian citizenship

20 skilled hull and structure workers, of which a minimum of 5 must have Norwegian citizenship

20 skilled ISO professionals, of which a minimum of 5 must have Norwegian citizenship

20 engineers in ship technical systems, of which a minimum of 5 must have Norwegian citizenship

6 technical illustrators, of which a minimum of 2 must have Norwegian citizenship

Relevant expertise as required to execute the framework agreement is described in further detail in Qualification documents, Annex 6 - Competence requirements

If the tenderer is a tenderer group, the contracting authority will evaluate the fulfilment of the requirement for the tenderer group as a whole. The tenderer should deliver the following documentation: A description of the tenderer's organisation of their own personnel and the personnel that they otherwise command, including the total staff and the competence and citizenship of the personnel. CVs are not to be submitted.

(K6) The tenderer must have competence in military capabilities that can impact the execution of the mission. Including

If the tenderer is a tenderer group, the contracting authority will evaluate the fulfilment of the requirement for the tenderer group as a whole.

Documentation: A description of competence and experience in connection with the military capabilities listed in the qualification documents of the tenderer's own personnel and the personnel that they otherwise command.

(K7) The tenderer must command docks and infrastructure in Norway that are suitable for the execution of the contract.

The requirement is considered fulfilled when the requirements of the Contracting Authority in Annex 5 are fulfilled, or when the tenderer proves that the requirements in Annex 5 of Qualification documents will be fulfilled no later than 3 months after the contract enters into force. The tentative date for the contract to go into force is 19/10/2023, but this date is subject to change. Documentation: The tenderer must prepare a document describing fulfilment of the requirements in Annex 5 of the Qualification documents.

If the tenderer's dock and infrastructure do not fulfil all of the requirements in Annex 5 of the Qualification documents at the time of delivery of the qualification documents, the tenderer must submit an overview of the deviation and a plan for implementation of the relevant upgrades / modifications.

(K8)The tenderer must have a Quality Management System that complies with the requirements in ISO 9001:2015 Quality management systems - Requirements, and within a scope that is relevant to the delivery scope of the contract. If the tenderer is a tenderer group, the requirement must be fulfilled by each participant in the group that will perform work under the contract. Documentation: The supplier must deliver a copy of a valid ISO 9001:2015 certificate with a Scope that is relevant to the delivery scope of the contract, issued by an accredited third-party certification organisation.

If the tenderer does not have a valid ISO 9001:2015 certificate, the tenderer must submit a compliance matrix that shows compliance between the tenderer's Quality Management System, with reference to the requirements in ISO 9001:2015 (Main sections and sub-section). The conformity matrix must make concrete references to documented information (process descriptions, procedures, instructions, etc.) in the tenderer's Quality Management System, with reference to the document name/number and the requirements in ISO 9001:2015. The Scope of the system must be clearly stated.

If the tenderer is a tenderer group, the aforementioned documentation must be submitted for each individual participating in the group who will perform work under the contract. It must also state what the individial participant must contribute under the total delivery scope of the contract and how it is ensured that system is implemented in the company that is to be established, cf. the Qualification documents point 4.3.

(K9) The tenderer must have a system for systematic environmental management at a level equal to the latest version of the ISO 14001 series. If the tenderer is a tenderer group, the requirement must be fulfiled by each individual participant in the group. Documentation: General concise description of the environmental management system implemented in the business (for example, table of contents and summary). If the tenderer can present certificates as documentation that the tenderer meets the requirements of the EU Eco-Management and Audit Scheme (EMAS), other recognised environmental management systems in Europa-Parlementets og Rådets Forordning (EF) no. 1221/2009 article 45 or other environmental management standards based on relevant European or international standards from accredited organisations, e.g. ISO 14001, or equivalent certificates issued by organisations in other EEA countries, it will be sufficient to provide a copy of the valid certificate.

If the tenderer is a tenderer group, the above-mentioned documentation shall be supplied for each individual participant in the group. It must further state how it is ensured that the system is implemented in the company that is to be established, cf. Qualification documentation section 4.3

Andre særlige vilkår:

The tenderer must have a shipyard located in Norway for deliveries during the framework agreement. Furthermore, a security contract and supplier declaration will be entered into with the selected tenderer on a CONFIDENTIAL level. Other particular terms will be in the qualification and tender documentation.
