The contracting authority to this assignment is Agder Kollektivtrafikk AS and Agder
County Agder Kollektivtrafikk AS is responsible for planning, coordinating and marketing subsidised public transport in Agder. The contracting authority comprising Agder fylkeskommune and Agder kollektivtrafikk AS
invites tenderers to a tender contest for passenger transport services, including ordinary transport of pupils, individually adapted school transport services, ordinary scheduled transport in accordance with bookings and facilitated transport (TT) in accordance with bookings. The agreement is divided into 8 lots / transport areas. (Lindesnes, Lyngdal, Farsund, Kvinesdal, Flekkefjord, Sirdal, Åseral and Hægebostad). A framework agreement will be entered into with one supplier for each transport area.

Agder kollektivtrafikk (AKT) [Agder Public Transport] and Agder County Municipality (Afk) consider it to be impossible to hold the contest for technical reasons, and that the Procurement Regulations § 13 4 letter b no. 2 thereby grants the authority to carry out the procurement without a contest. On 30 April 2022, AKT and Afk announced an open tender for the procurement of passenger transport services (Doffin reference 2022-399369). The procurement was divided into eight lots. AKT and Afk planned to enter into a contract with one tenderer for each area. One was offer was received from Elite-Drosjen for 6 of the 8 lots. This offer contained significant deviations from the procurement documentation, and was therefore rejected from the contest, cf. procurement regulations § 24-8 (1) letter b. The contest was then concluded without having entered into a framework agreement. AKT and Afk have subsequently been in negotiations with Elite-Drosjen in six of the eight areas/municipalities. The voluntary ex-ante transparency notice concerns entrance into an agreement with Elite-Drosjen

No tenders were submitted for Aseral and Hægebostad municipalities. The contest has been concluded without having entered into any framework agreement. AKT and Afk have subsequently been in negotiations with Taxi Sør regarding entry into an agreement for passenger transport in two of the eight areas/municipalities for which tenders were not submitted. The voluntary ex-ante transparency notice concerns entry into an agreement with Taxi Sør AS. See the annex for further information.
