Tenderers must fill in the ESPD in KGV light [the tender management tool light], as provisional documentation of fulfilment of the qualification requirements and that there are no reasons for rejection and that any selection criteria are fulfilled.

• Company Registration Certificate

Tenderers must be a legally established company.

Documentation requirement:

Norwegian companies: Company registration certificate, not older than one month at the application deadline.

Foreign companies: Documentation proving that the company is registered in a trade or business register as prescribed by the law of the country where the tenderer is established. The documentation shall not be older than one month from the application deadline.

• Tax and VAT certificate

Tenderers must have their tax and VAT payments in order.

Documentation requirement: Companies who are liable for tax and duties in Norway: Tax and VAT certificate, not older than 6 months, calculated from the deadline for requests for pre-qualification.

Companies who are liable for tax and duties abroad shall submit an equivalent certificate as mandated by the legislation in the country where the tenderer is registered as a company.

• Requirement concerning the tenderer’s economic and financial capacity.

Tenderers must have sufficient financial capacity to fulfil the contractual obligations. The contracting authority will obtain a credit rating of tenderers itself.

Requirements concerning the tenderer’s technical and professional qualifications

The tenderer shall have adequate financial capacity to carry out the assignment. To be qualified, the tenderer must have at least the number of vehicles in different categories specified in Annex 2 - production overview. If the tenderer does not have a sufficient number of vehicles at the time of the tender deadline, the tenderer must enclose documentation showing that he will receive the sufficient number before the agreement is initiated.

On 30 April 2022, AKT and Afk announced an open tender for the procurement of passenger transport services (Doffin reference 2022-399369). The procurement was divided into eight lots. AKT and Afk planned to enter into a contract with one tenderer for each area. One was offer was received from Elite-Drosjen for 6 of the 8 lots. This offer contained significant deviations from the procurement documentation, and was therefore rejected from the contest, cf. procurement regulations § 24-8 (1) letter b. The contest was then concluded without having entered into a framework agreement. AKT and Afk have subsequently been in negotiations with Elite-Drosjen in six of the eight areas/municipalities. The fact that there is a lack of competition in the above areas has been the case for a number of years. AKT and Afk have previously carried out multiple tender contests for the delivery of passenger transportation services in these areas and have experienced a lack of tender submissions. As understood by AKT and Afk, this is due to a lack of capacity on the part of the tenderers.

There is nothing indicating that, by announcing the procurement of passenger transport services in the applicable areas again, more offers will be received, thereby achieving an actual competition. Therefore, AKT and Afk consider it unnecessary use of
