Framework agreement for a review of the regulation and financing of private nurseries - legal and economic problems

The government wants to give small privately owned and non-profit nurseries better framework terms, and stop the development where commercial actors are owning more and more nurseries. The government will regulate the procurement and sale of nurseries more strictly, assess municipal first refusal, and ensure that public subsidies and parent payments go to running the nursery. The rules will also give municipalities greater possibilities to manage financing and set requirements for private nurseries.
The contracting authority will start the work on the rules, and therefore needs analyses and a review of various legal and economic problems. The contracting authority would like to enter into a two-year framework agreement for the regulation and financing of private nurseries, with an option for an extension for one year. Delivery will be in the form of reports, legal opinions, presentations, and continual advice and discussions.

Beskrivelse av opsjoner:
The framework agreement will be valid for two -2- years, with an option for an extension for one -1- year. The contracting authority will continually make call-offs on the framework agreement in the contract period as needed. Most of the work will be in the period autumn 2022 - spring 2023.

Vilkår for deltakelse
Egnethet til å utøve yrkesvirksomheten:
Requirements: Tenderers must be a legally established company.
Documentation:
Norwegian companies: Company registration certificate or a printout from the Unit Register for sole proprietorships not required to register.
Foreign tenderers: Verification that the tenderer is registered in a trade or business register as prescribed by the law of the country where the tenderer is established. The verification can be submitted in writing or by referring to BRIS.
Økonomisk og finansiell stilling:
Requirement: Paid taxes and duties.
Documentation:
A certificate, not older than 6 months, which verifies that the tenderer has fulfilled the obligations of payment of taxes, social security contributions and VAT. The certificate can be ordered and obtained from Altinn by using a separate link on skatteetaten.no. Foreign tenderers must provide certificates from equivalent authorities to the Norwegian authorities.

Teknisk og faglig kapasitet:
Requirement: Tenderers must have sufficient ability and experience to carry out the delivery.
Documentation: A description of the tenderer's up to three most relevant assignments in the last three years, together with information on the contract's value, date of delivery or execution, and the name of the recipient. Relevant assignments means analyses of private actors that operate statutory services for the public. Tenderers are responsible for ensuring that the description is of such a nature that it verifies compliance with the requirement.
