Folkehelseinstituttet [the Norwegian Institute of Public Health] is holding an open tender contest with the aim of ensuring sufficient delivery of four valent vaccine against seasonal influenza (ATC code J07B B02) for vaccination of persons in defined risk and target groups (see the tender documentation point 1.4) for the 2023/2024 and 2024/2025 seasons, with an option for a further two seasons.
The contest is being held electronically in the CTM KGV and information given in the tender management tool, in the prior information notice and the tender documentation stipulate the rules and terms for the contest.
According to the Tender documentation, chapter 6 "Award criteria" are the contest award criteria Price 70% and Quality - Technical characteristics 30%. The tender documentation has several minimum requirements for the vaccine. All the minimum requirements must be fulfilled. NIPH aims to award two partial contracts for 60% and 40% of the total contract volume.

The contract period is 2 years, with an option for 1+1 year extension. The option for an extension will be automatically taken up for one year at a time, unless the contracting authority gives notice on the contract in accordance with the Supply Agreement, point 17. The contracting authority aims to sign the contract shortly after the procurement is implemented.

Økonomisk og finansiell stilling:

Tenderers must have sufficient economic and financial capacity to comply with the contract. Creditworthiness with no requirement for guarantees will be sufficient to meet the requirement.

Documentation requirement:

Credit rating based on the most recent accounting figures. The rating must be carried out by a credit rating agency with a licence to provide such service.

If a tenderer has valid reasons for not being able to provide the documentation requested by the contracting authority, the tenderer can document his economic and financial capacity by presenting other documents considered suitable by the contracting authority.

Teknisk og faglig kapasitet:

The tenderer must have the requisite permissions to be able to fulfil the contract.

Documentation requirement:

If the tenderer is the manufacturer of the vaccine, permission must be presented from relevant EU/EEA authorities to manufacture pharmaceuticals.

If the tenderer is not the manufacturer of the vaccine, the requisite permissions from relevant EU/EEA authorities to trade in pharmaceuticals must be presented.

If the tenderer imports the vaccine, the import license that includes the offered vaccine must be presented.

Vilkår for kontraktoppfyllelse:

Amendment clause in line with PPR §19-1 second sentence: Depending on availability, the maximum number of doses can be increased by up to 20% if a situation arises where national recommendations are changed so that the number of people in risk or target groups for seasonal influenza vaccination (ref. Section 1.4 of the tender documentation) increases significantly, (Supply Agreement point 3.4)

Section 1.9 of the tender documentation lists a selection of contract terms. All contract terms appear in the Supply Agreement with annexes.

The contract value stated in section II.1.7) of the tender notice represents the contracting authority's estimated value of the contract at the time of the publication of the contest. Pursuant to section §13 of the Freedom of Information Act and § 13, first paragraph, point 2) of the Public Administration Act, the real contract value is not published (ref. Section V.2.4 of the tender notice). Unit price (Price per dose) is the only price element in the contest. The contracting authority considers unit prices to be information of competitive importance to keep secret from the person to whom the information relates, who in this case is the vaccine supplier that has been awarded sub-contracts after the contest. If the real sub-contract values had been published in the tender notice, it would have been possible to calculate the unit price based on the contract value and publicly known information about the number of doses in the contract. The contracting authority informs that the contract value is above the Public Procurement Regulations' upper threshold value and lower than the estimated procurement value, cf. Section II.1.7)

The Norwegian Institute of Public Health's annual need for seasonal influenza vaccines is estimated to be between 1,300,000 doses/annum and 1,800,000 doses/annum in total.

In accordance with the Supply Agreement point 3.2, the Norwegian Institute of Public Health is obliged to procure a minimum volume of 1,300,000 doses a year in total in accordance with the following distribution:

Supplier 1: 780,000 doses (60%)

Supplier 2: 520,000 doses (40%)

The volume that the Norwegian Institute of Public Health will order in addition to the minimum volume will depend on the expected demand and will be ordered according to the same 60:40% distribution.
