EEA 001-2022 Framework agreement for paint and paint products

Bergen Kommune - Innkjøp Konsern

Bergen, Modalen, Osterøy and Øygarden Municipalities, as well as Bergen Church Council and Betanien rehabilitation and nursing home would like to enter into a new framework agreement for paint, painting products, painting equipment, and logically associated products. Askøy Municipality reserves the right to join the contract if the tenderer has a sales outlet in Askøy or in west Bergen. The contract will not apply for the municipal company Øygarden Bustadutvikling KF.
All products in this agreement must be of professional quality. Products not designed for professional use must not be offered. The products do not need to be designed only for professional use, but must have characteristics that professional painters expect of such products.

For Bergen Municipality, the contract will primarily cover the need of Bergen Municipality's internal painter department under the Agency for Building and Property. The contract will, thus, primarily cover a professional need.

Paint products that will be used on historical and listed buildings, including linseed oil products that do not include alkyd oil or solvents, and which have a non-volatile matter of 90% or higher, will not be included in the contract.

Varighet: 24 måneder
Beskrivelse av fornyelser: Option for an extension of the contract for up to a further 24 months.

Egnethet til å utøve yrkesvirksomheten:

Tenderers must be registered in a company register or trade register in the member state where the tenderer is established. As described in annex XI of directive 2014/24/EU; tenderers from certain member countries can be required to fulfil other requirements in the mentioned annex.

Minimum requirements for the qualification requirements:

Tenderers must be a legally established company. Documentation: Tenderers registered in the Norwegian Register of Business Enterprises do not need to enclose documentation. The contracting authority will control the registration by using the organisation number provided in the tenderer's Mercell profile. For tenderers that are not registered in the above-mentioned register, the tenderer must provide certificates or confirmation of registration (equivalent to a company registration certificate) in a trade register or company register as described in the legislation in the country where the tenderer is established. The certificate must not be issued more than 6 months prior to the tender deadline.

Teknisk og faglig kapasitet:

1) Tenderers must have adequate competence and professional qualifications for managing and quality assuring the delivery.

2) The contracting authority requires that all tenderers have an established quality management system that is satisfactory to ensure quality in the execution of this contract.

Minste nivå(er) av standarder:

re 1) Personnel who will provide professional advice to orderers must have minimum the following competence: Certificate of apprenticeship for the painting profession, alternatively, broad product competence developed over minimum 3 years relevant vocational experience with the delivery of paint products, as well as courses relevant for product competence.

re 2) Documentation Requirement: A description of the company's implemented quality management system. Certificates must be submitted for the company's quality management system, issued by independent bodies, confirming that the company meets specific quality management standards, for example ISO 9001. If a company does not have a certificate, other documentation of the company's quality management system must be presented. In such cases, the following must, as a minimum, be submitted: * The system's name and a detailed table of contents * A general description of the system's contents, including an overview of check plans and check-lists that are relevant for this contract * An organisation chart that shows responsibilities in the quality assurance system * A description of procedures for internal control and handling deviations (work with corrective and preventive measures) * A description of how the system will be used to ensure quality in this contract. All submitted or collected documentation will form the basis for an overall evaluation of whether the qualification requirement is fulfilled.
